A “segurança jurídica” como fundamento à insegurança : um estudo a partir da “tese do século”

Abstract

Esta monografia tem como objetivo analisar problemas recentes envolvendo o princípio da segurança jurídica e a sua projeção no tempo a partir de um caso específico: "a tese do século". A problemática decorre da má aplicação e compreensão de mecanismos voltados justamente à promoção e proteção do referido princípio, seja em âmbito geral, individual, objetivo e subjetivo. Tais questões são controvertidas, porque aparentam conflitar-se, o que densifica a insegurança no cenário apresentado, podendo ser projetada a casos vindouros. Para que se investigue esse panorama, na primeira parte estão assentadas as premissas teóricas, abordando se desde o perfil conceitual do princípio da segurança jurídica até os mecanismos que servem à sua proteção e promoção em razão das mudanças decorrentes do transcurso do tempo, realizando-se a sua devida distinção. São eles: os precedentes, a sua formação e superação; a modulação de efeitos em controle de constitucionalidade; e a intangibilidade pela coisa julgada. Após, busca-se aplicar as posições doutrinárias e jurisprudenciais adotadas à análise do caso, identificando-se os problemas que dele decorrem e que confirmam a hipótese que intitula este trabalho. Ao fim, são propostas possíveis soluções à luz da segurança jurídica, para que também possam servir de base a casos futuros.

This monograph aims to analyze recent problems involving the principle of legal certainty and its prospection in time from the study of a specific case: "the century's thesis". The problem stems from the poor application and bad understanding of mechanisms focused precisely on the promotion and the protection of legal certainty, whether in a general, individual, objective or subjective way. Such issues are controversial because they seem to conflict, which intensifies the insecurity in the presented scenario and that can also be forseened in others to come. In order to investigate this situation, in the first part the theoretical premises are established, going from the basic ideals and generalities of the principle of legal certainty to the distinct mechanisms that serve to protect and promote it when there are abrupt modifications in law resulting from time passing. The mechanisms are precedents - their formation and their overrulling or overturning -, the prospective effects of decisions in judicial review and the inviolability of res iudicata. After that, the theoretical positions adopted are applied to the analysis of the case in study, identifying the problems that arise from it which confirm the hypothesis that entitles this work. In the end its proposed possible solutions to the case in the light of legal certainty so they can also be used as a basis for future cases.
