Feminicídio e a culpabilização da vítima : os mecanismos de combate à violência contra a mulher no município de São Leopoldo após a pandemia da COVID-19

Abstract

Muito se trabalha para modificar esses atos que violam os direitos humanos e desafiam aqueles que atuam para garantir a proteção e o retorno dessas mulheres ao convívio social, embora exista ainda a ameaça constante de seus agressores. Por fim, será realizado estudo para saber quais as redes de atuação no combate a violência doméstica e familiar existem no Município, nessa luta por igualdade, equidade e a garantia da segurança e direito à vida dessas vítimas que buscam por respeito em meio aos crimes de feminicídio e outros que caracterizam a prática da violência de gênero. A questão da violência contra a mulher se faz presente na história da humanidade perpassando momentos históricos até os nossos dias. Essa violência está em constante discussão nas instituições judiciais à luz das normas de proteção e amparo à mulher: as Leis nº 11.340/2006 (Maria da Penha), 13.104/2015 (instituiu o crime de feminicídio) e 12.845/2013 (dispõe sobre o atendimento a pessoas em situação de violência). Para que se minimize, de fato, todos os tipos de agressão contra a mulher, é preciso abordar os desafios que apontam as redes de diretrizes de políticas que almejam combater o tratamento violento direcionado a elas, Essa identificação vem a ser análoga à característica herdada da época do patriarcado que se repete na sociedade contemporânea, não diferentemente na sociedade leopoldense e essa espécie de caracterização pode incidir em crimes de tipo psicológico até a prática do feminicídio. O presente trabalho apresenta o tema do feminicídio e a culpabilização da vítima, para analisar os crescentes casos de agressões que culminam em feminicídio vistos na mídia e no meio social, a perspectiva é entender por que esses crimes são causados esclarecendo, por meio de dados a questão da culpabilização das vítimas no cerne do Direito Penal, bem como identificar as possíveis lacunas que existem nos mecanismos de proteção do Estado. Através de 5 capítulos abordar-se-á os direitos da mulher, breve noções dos direitos humanos, os casos de violência, o feminicídio, bem como a atuação policial junto às redes multidisciplinares de apoio à mulher, tendo por objetivo conhecer os elementos usados em defesa da mulher, os “aparelhos” de atuação para proteção dessa das vítimas ao se encontrarem dependentes emocionalmente e financeiramente de seu agressor.
