dc.description.abstract | Este trabalho propõe-se a analisar o contrato de trabalho intermitente, figura contratual inaugurada pela Reforma Trabalhista operada pela Lei nº 13.467/17. Busca-se verificar a interferência da nova modalidade na precarização dos direitos trabalhistas. O trabalho divide-se em duas partes, do geral ao particular. Na primeira parte, desenvolve-se a característica do direito do trabalho como um direito social, levando à análise de quatro parâmetros delimitadores deste campo jurídico: (i) o trabalho decente com a garantia a um salário mínimo; (ii) os principais princípios do direito do trabalho; (iii) a flexibilização das normas laborais e seus limites, e, por fim, (iv) o trabalho digno como viabilizador de outros direitos sociais. Na segunda parte, analisa-se, especificamente, o instituto do trabalho intermitente sob três aspectos: (i) as modalidades contratuais anteriores à Reforma Trabalhista; (ii) o trabalho intermitente disciplinado pela Lei nº 13.467/17, bem como pela Medida Provisória nº 808/17 e Portaria nº 349/18 do Ministério do Trabalho, e (iii) o impacto social do trabalho intermitente. Por fim, verifica-se que o trabalho intermitente, ao regulamentar o trabalho informal reconhecido popularmente por "bico", demonstra-se capaz de gerar prejuízos não só aos trabalhadores, como também à sociedade em geral. | pt_BR |
dc.description.abstract | This paper proposes itself to analyse the intermittent employment, a contractual figure launched by the Labour Reform, operated by the Law nº 13.467 of 2017. It’s sought to verify this new modality’s interference at the labour rights precariousness. The paper is divided in two parts, from general to particular. At the first part, there’s the development of the labour rights characteristics as a social right, leading to the analysis of this legal field’s four delimitating parameters: (i) decent labour as a guarantee of minimum wage; (ii) labour right’s main principles; (iii) labour standards flexibilization and its limits; (iv) dignified work as an enabler of other social rights. At the second part, there’s the specific analysis of the intermittent employment under three aspects: (i) the contractual modalities prior to the Labour Reform; (ii) the intermittent employment disciplined by the Law nº 13,467 of 2017, as well of the Temporary Measure nº 808 of 2017 and the Labor Departament’s Decree nº 349 of 2018, and (iii) the intermittent labour’s social impact. At last, it’s verified that the intermittent employment, by regulating the informal labour popularity known as “gig”, demonstrates itself to be capable of harming not only the workers, but also the society in general. | en |
