A mulher e o ordenamento jurídico : o direito de família sob a perspectiva de gênero

Abstract

O presente trabalho realiza uma análise do tratamento jurídico que é conferido à mulher no ordenamento brasileiro, notadamente no Direito de Família. A partir da observação da influência exercida pelos papéis de gênero na sociedade, verificou-se a necessidade de um olhar aprofundado para essa questão. Para tanto, elencou-se os documentos legais que tiveram maior relevância para a mulher, enquanto sujeito de direito, seja positiva ou negativamente. O formato utilizado, isto é, a apresentação de uma evolução da legislação, em ordem cronológica, foi escolhido com o objetivo de facilitar a compreensão da matéria em estudo, demonstrando a sua importância histórica. Com esta pesquisa, espera-se que os leitores sejam capazes de refletir sobre a perspectiva de gênero, que impactou, de forma especial, na luta feminina pelo reconhecimento jurídico, e que, a despeito dos avanços sociais que, no decorrer do tempo, vêm sendo construídos, continua afetando a mulher nos mais variados aspectos da vida.

This article performs an analysis of the legal treatment accorded to women in the Brazilian legal system, especially in Family Law. According to the observation of the influence exerted by gender roles in society, there was a need for a thorough look at the issue. For that, it was listed the legal documents that had more relevance for the woman, as subject of law, either positively or negatively. The format used, that is, the presentation of an evolution of the legislation, in chronological order, was chosen with the purpose of facilitating the understanding of the subject under study, demonstrating its historical importance. With this research, readers are expected to be able to reflect on the gender perspective, which has had a special impact on women's struggle for legal recognition, and which, despite social advances, throughout history, continues to affect women in the most varied aspects of life.
