A lei 13.467/2017 e a (des)proteção da mulher : análise sobre a tarifação do dano extrapatrimonial trabalhista

Abstract

O presente trabalho objetivou analisar se a tarifação do dano extrapatrimonial trabalhista, inserida pela lei 13.467/2017, contribui para a discriminação das mulheres em relação aos homens. Para tanto, realizou-se análise histórica acerca do desenvolvimento do conceito de responsabilidade, passando-se para a proteção legal incidente sobre a temática do dano moral trabalhista e, após, tratou-se dos dispositivos adicionados pela Reforma Trabalhista. Em seguida, fez-se uma exposição histórica sobre a evolução da inserção da mulher no Direito do Trabalho no Brasil, assim como uma análise estatística sobre o atual contexto brasileiro do trabalho da mulher e, por fim, falou-se sobre os tipos de danos às trabalhadoras. Por último, examinou-se decisões proferidas antes e depois da entrada em vigor da tarifação, analisando-se de forma crítica o instituto. Concluiu-se, então, que a tarifação baseada no último salário da pessoa trabalhadora contribui para a discriminação das mulheres, uma vez que estas experienciam com mais frequência certas situações ensejadoras de reparação por dano moral, bem como possuem salários mais baixos, o que afeta o valor da indenização.

This Project aimed to analyze if the rate of the off-balance-sheet labor damage, inserted by the law 13.467/2017, contributes to the discrimination of women towards men. Therefore, it was carried out a historical analysis about the development of the concept of responsibility, passing to the incident legal protection about moral labor damage thematic and, after, treated about the added devices by the Labor Reform. Then, it was realized a historical exposition about the Evolution of the Woman insertion on the Labor Law in Brazil, as well as a statistical analysis upon the current brazilian context of Woman labor and, lastly, it was spoken about the damage types in female workers. In the end, it was explored the decision given before and after the charging enter into force, critically analysing the institute. It was concluded, then, that the rate based on the last salary of the worker contribute to the discrimination of women, once that they experience more often some situations that needs repair because of the moral damage, as they have lower salaries, that afects the compensation amount.
