A liberdade de expressão em John Stuart Mill e o discurso de ódio

Abstract

O presente trabalho foi feito com o objetivo de analisar as ideias de John Stuart Mill sobre a liberdade de expressão e sua importância e atualidade no debate atual sobre o tema. O estudo iniciou com o exame do pensamento utilitarista, que é a base moral do pensamento do autor britânico, demonstrando sua importância para suas ideias sobre a liberdade do indivíduo, prosseguindo com a análise dos maiores argumentos de Mill em favor da liberdade de pensamento e finalizando com considerações sobre os limites da liberdade de expressão. Assim, o trabalho pretende demonstrar a importância e a atualidade do pensamento liberal de John Stuart Mill, assim como a inaplicabilidade do chamado “discurso de ódio” no princípio do dano alheio.

The present work was made with the objective of analyzing John Stuart Mill's ideas about freedom of expression and it’s the importance and timeliness in the current debate about the subject. The study started with the examination of utilitarian thinking, which is the moral basis of the British author's thought, demonstrating its importance for his ideas about the freedom of the individual, proceeding with the analysis of Mill's main arguments in favor of freedom of thought and concluding with considerations on the limits of freedom of expression. Thus, the work aims to demonstrate the importance and timeliness of John Stuart Mill’s liberal thought, as well as the inapplicability of the so-called “hate speech” in the harm priciple.
