A invisibilidade jurídica das famílias poliafetivas

Abstract

O presente trabalho tem por objetivo analisar a poliafetividade no contexto brasileiro e justificar a viabilidade de seu reconhecimento jurídico. Com o passar dos tempos, o conceito de família sofreu diferentes transformações. A diversidade social e os ventos da contemporaneidade permitiram uma ampliação do conceito de família. O relacionamento poliafetivo, por sua vez, admite que mais de duas pessoas possam identificar-se como um casal e constituir família, desde que observado o consentimento de todos os partícipes da relação. Atualmente, esse modelo de célula familiar encontra vazio legislativo e obstáculos ao reconhecimento, estes enraizados em concepções morais e religiosas, que utilizam a máscara da juridicidade para fundamentar seus discursos. A partir da aplicação dos princípios constitucionais da dignidade da pessoa humana e do afeto, não há qualquer óbice ao reconhecimento do arranjo familiar poliafetivo. Ao Estado não cabe interferir na autonomia privada e no livre planejamento familiar, mas garantir proteção e tutela às diferente estruturas familiares.

The present study aims to analyze polyaffectivity in the Brazilian context and justify the feasibility of its legal recognition. Over the years, the concept of family has undergone different transformations. The social diversity and the winds of contemporaneity allowed an expansion of the concept of family. The polyaffective relationship, in turn, admits that more than two people can identify themselves as a couple and constitute a family, as long as the consent of all participants in the relationship is observed. Currently, this family cell model finds a legislative vacuum and obstacles to recognition, rooted in moral and religious conceptions, which use the mask of legality to base their discourses. From the application of the constitutional principles of the dignity of the human person and affection, there is no obstacle to the recognition of the polyaffective family arrangement. It is not up to the State to interfere in private autonomy and free family planning, but to guarantee protection and protection to the different family structures.
