A ala separada para LGBT da cadeia pública de Porto Alegre na proteção dos direitos das travestis privadas de liberdade

Abstract

O presente trabalho de conclusão tem como tema a proteção dos direitos das pessoas travestis privadas de liberdade na ala específica para LGBT da Cadeia Pública de Porto Alegre (CPPA). Seu objetivo é verificar a eficácia deste mecanismo na tutela dos direitos destes indivíduos. Assim, o problema norteador da pesquisa reside em confirmar se a referida ala garante o respeito aos direitos dessas prisioneiras, em especial aos direitos à identidade, à integridade física e moral, à educação, ao trabalho, ao lazer e à saúde. Como metodologia de natureza qualitativa, utiliza-se pesquisa bibliográfica e documental para a realização do estudo teórico sobre o assunto. Ademais, são utilizados dados coletados a partir de pesquisas empíricas realizadas após o surgimento da ala na CPPA para a análise da efetivação desses direitos, tendo em vista que, infelizmente, devido à pandemia ocasionada pela COVID-19, o trabalho não pode contar com uma pesquisa de campo própria.

Protection of the rights of "travestis" persons deprived of their liberty in the specific wing for LGBT persons of the public jail in Porto Alegre (CPPA) is the subject of the present work. The aim is to verify the effectiveness of this mechanism in the protection of the rights of these individuals. Thus, the purpose of this research lies in confirming whether the separate wing guarantees respect for the rights of these prisoners, in particular the rights to identity, physical and moral integrity, education, work, leisure and health. As a methodology of qualitative origin, bibliographic and documentary research is used to carry out the theoretical study on the subject. Besides, data collected from empirical investigations carried out after the emergence of the separate wing in the CPPA are used to analyze the effectiveness of these rights, taking into account that unfortunately this work could not count on its own empirical investigation due to the pandemic caused by COVID-19.
