O instituto da infiltração virtual no combate à pornografia infantojuvenil no ambiente virtual

Abstract

A expansão no uso da internet atingiu também o público infantojuvenil, de forma que cada vez mais crianças estão tendo contato com a internet e cada vez mais cedo este contato está ocorrendo, de maneira que essa parcela da população fica vulnerável à ação de delinquentes sexuais no ciberespaço. Nesse contexto, a presente pesquisa abordará a temática do instituto jurídico da infiltração policial virtual empregada no combate aos crimes contra a dignidade sexual das crianças e adolescentes. A pergunta fundamental que o trabalho busca responder é a seguinte: a infiltração de agentes na modalidade virtual é um meio investigativo dotado da efetividade necessária para elucidar os crimes virtuais relacionados à pornografia infantojuvenil? Para o alcance desse intento, este trabalho, por meio de pesquisa bibliográfica, aborda, no primeiro momento, a evolução da proteção jurídica à criança e adolescente, o que culminou na criação dos tipos penais relacionados à pornografia infantojuvenil, após, a pesquisa se foca na evolução legislativa do tema infiltração de agentes em nosso ordenamento jurídico, em seguida, é conduzido um estudo a respeito do conceito e agente infiltrado, bem como de figuras jurídicas afins, a seguir, o foco passa aos aspectos procedimentais e operacionais da infiltração de agentes em meio virtual, para só então, no ápice desta monografia, analisar três operações da Polícia Federal em que o instituto estudado foi aplicado, a fim de avaliar a efetividade do instituto.

The dissemination in the use of the internet also reached the children and the youth audience in general, therefore we can say that more children are having contact with the internet and this contact is occurring more and more earlier, so this portion of the population becomes an easy target for sex offenders on cyberspace. In this context, this research will address the theme of the legal institute of virtual police infiltration used in combating crimes against the sexual dignity of children and adolescents. The fundamental question that the paper seeks to answer is the following: is the infiltration of agents in the virtual form is an investigative technique with the necessary effectiveness to elucidate virtual crimes related to child pornography? To achieve this objective, this work, through bibliographical research, addresses, at first, the evolution of legal protection of children and adolescents, which culminated in the creation of criminal offenses related to child pornography, after which the research focuses in the legislative evolution of the theme of infiltration of agents in our legal system, the paper is then conducted regarding the concept and infiltrated agent, as well as related legal figures, then the focus shifts to the procedural and operational aspects of infiltration of agents in a virtual environment, for only then, at the apex of this monograph, to analyze three Brazilian Federal Police operations in which the studied institute was applied, in order to assess the institute's effectiveness.
