dc.description.abstract | O estudo trata de possível caso de discriminação racial em ambiente de trabalho sofrido por trabalhador negro motivado pelo uso de cabelo tipo “black power”, face a determinações de corte de cabelo, por três vezes, sob a alegação de aparência de desleixo, sujeira e chamar a atenção no ambiente de trabalho. Conforme a ré, o a determinação do corte do cabelo era para evitar riscos de mau uso dos Equipamentos de Proteção Individual (EPIs), em vista de normas de segurança do trabalho. Restou provado que houve reiteração da determinação do corte do cabelo do trabalhador, embora a prova pericial técnica tenha demonstrado que não houve fundamento normativo, técnico ou científico sobre riscos ao uso dos EPIs devido ao cabelo “black power” do obreiro. Analisadas a sentença e acórdão, com base em suporte teórico acerca do possível caso de racismo estrutural, face as vicissitudes do “tornar-se negro” em uma sociedade racista como a brasileira, a valorização da estética negra como componente de afirmação identitária, conclui-se que o sistema de justiça restou por não reconhecer o racismo estrutural no ambiente de trabalho. Ressalta-se que a sentença informa que a ré não apresentou elementos suficientes para afastar o caráter discriminatório da despedida, ainda assim absolveu da imputação, bem como o acórdão reforma a sentença deixando de condenar a ré a indenizar o autor por danos morais, bem como a obrigação de fazer e o pagamento de honorários periciais e sucumbenciais, condenando, por outro lado, o obreiro ao pagamento de sucumbência. | pt_BR |
dc.description.abstract | The study deals with a possible case of racial discrimination in the workplace suffered by a black worker motivated by the use of "black power" hair, in the face of haircutting decisions, three times, under the allegation of sloppiness, dirt and draw attention to the work environment. As the defendant, the determination of the haircut was to avoid risks of misuse of Personal Protective Equipment (PPE), in view of work safety standards. It was proven that there was a reiteration of the determination of the worker's haircut, although the technical expert evidence has shown that there was no normative, technical or scientific basis on the risks to the use of PPE due to the worker's “black power” hair. After analyzing the sentence and judgment, based on theoretical support about the possible case of structural racism, given the vicissitudes of “becoming black” in a racist society like Brazil, the appreciation of black aesthetics as a component of identity affirmation, concluded. it appears that the justice system was left for not recognizing structural racism in the workplace. It is noteworthy that the sentence informs that the defendant did not present sufficient elements to rule out the discriminatory nature of the dismissal, even so it acquitted of the imputation, and the judgment reforms the sentence failing to sentence the defendant to indemnify the plaintiff for moral damages, as well as the obligation to perform and the payment of expert fees and loss of suit, condemning, on the other hand, the worker to the payment of loss of suit. | en |
