Limites espaciais para a atuação do exército brasileiro no policiamento urbano : da proteção de aquartelamentos militares às operações de garantia da lei e da ordem

Abstract

O presente trabalho busca discutir, a partir da perspectiva da geografia jurídica, os limites espaciais para a atuação do Exército brasileiro no policiamento urbano. A pesquisa se insere no contexto crescente de militarização da segurança pública e tem como objetivo compreender a atuação do Exército no controle social de espaços urbanos por meio de duas modalidades, o policiamento cotidiano de áreas militares feito para a proteção de aquartelamentos militares e o policiamento excepcional nas operações de Garantia da Lei e da Ordem (GLO). Utilizou-se de técnicas da cartografia e do método de análise de conteúdo de documentos para averiguar a existência de critérios objetivos nas normas jurídicas que estabelecessem os limites espaciais para o policiamento urbano feito pelo Exército, instituindo espaços jurisdicionais. A análise empírica referente às operações GLO abrange decretos presidenciais no período de 2016 até 2019. Já a análise sobre as áreas militares tem como referencial empírico os aquartelamentos do Exército existentes na cidade de Porto Alegre atualmente. A partir da análise dos decretos presidenciais, foi possível observar um caráter vago nas informações referentes à espacialidade das operações GLO, possibilitando ampla margem de arbítrio quanto a utilização do Exército no policiamento das cidades em caráter excepcional. Por outro lado, quanto às áreas militares, constata-se que a atuação policial do Exército no espaço urbano assume um caráter cotidiano, com limites espaciais bem estabelecidos. No entanto, não resta claro se tais limites são plenamente respeitados.

This paper seeks to investigate the existence of spatial limits for the Brazilian Army's role in city policing through analyzing presidential decrees that establishes the "Law and Order Guarantee Operations" covering the period from 2016 to 2019, as well as the policing did for the protection of military barracks in the city of Porto Alegre. This research is part of the growing context of public security militarization, and aims to understand the Army's role in social control of urban public spaces. Thus, under the theoretical-methodological perspective of legal geography, from the concept of Jurisdictional Spaces proposed by Richard Ford and the theory entitled Symbolic Cartography of Law, written by Boaventura de Souza Santos, cartography and content analysis were uses as methods to verify the existence of objective spatial criteria that delimited the Army urban policing. In the first analysis, on a national scale, the decrees that institute Law and Order Guarantee Operations (GLO) provided for in the Federal Constitution art. 142 and having an episodic character, determined time and previously established area. In the second, the jurisdictional spaces mapping destined to the protection of military areas in Porto Alegre was carried out based on the administrative institute of military serfdom, which has a spatial criterion the measure 33 meters from the walls of military barracks as a delimitation of its role in the urban space. From the analysis of the decrees, it was possible to observe a vague character regarding the information regarding the spatiality of GLO Operations, allowing a wide margin of presidential discretion regarding the use of the Army in policing the cities in an exceptional way.
