As ideias acerca dos elementos constituintes do Estado e sua recepção por tratados luso-hispânicos do século XVIII

Abstract

O presente trabalho pretende estudar os Tratados Internacionais do século XVIII, objetivando resgatar as ideias e conceitos acerca de elementos constituintes do Estado, seja em seu âmbito formal (elementos derivados da concepção de soberania), seja em âmbito material (reflexões sobre a concepção de povo e território existentes à época), quanto formal. Toma a soberania como o aspecto formal e constituinte a ser estudado, uma vez que o governo depende da existência da mesma, sendo este fundado na figura do monarca, capaz de nomear representantes. É em seu nome e de seus herdeiros, que irá se conduzir os destinos de um Estado ainda personalizado. Abre assim, a possibilidade de um diálogo com as interfaces do aspecto político com o jurídico, visando contribuir desta forma com a pesquisa em História do Direito no Brasil, sem deixar de ser influenciado por um resgate da História do Pensamento Político, uma vez que realiza uma apreciação acerca da recepção de conceitos jurídicos e políticos neste país e na América Latina, a partir da herança colonial deixada pelos Tratados Internacionais em questão.

The objetive of the present work is to study the International Treaties of the eighteenth century, aiming to rescue the ideas and concepts of the constituent elements of the state, whether in the formal scope (elements derived from the concept of sovereignty), material scope (reflections on the design of people and territory existing at the time), or the formal scope. Sovereignty is considered as the formal constituent aspect to be studied, since the government depends on the existence of sovereignty, which is founded on the figure of the monarch, who is able to appoint representatives. It is in the name of the monarch and his heirs, who will lead the fate of a state still personalized. Henceforth, it is possible to discuss the interfaces of the political aspect with the legal one, in order to contribute to research in History of Law in Brazil without being influenced by the History of Political Thinking, since it analyzes the legal and political concepts in Brazil and Latin America, from the colonial heritage left by the International Treaties in question.
