A viabilidade para fazer cobrança de dívida ativa em cartórios de protesto no município de Osório/RS

Abstract

O presente trabalho teve por objetivo analisar a viabilidade de implantar o sistema de cobrança extrajudiciária através do protesto cartorário de Certidões de Dívida Ativa no município de Osório. Num primeiro momento buscou-se caracterizar o ambiente, descrevendo traços da realidade do município, e retratar a importância de tal matéria em seu âmbito, assim como identificar a problemática e traçar os objetivos geral e específicos da pesquisa. Já no segundo capítulo o autor da pesquisa analisou referências teóricas capazes de esclarecer pontos importantes do assunto, investigando questões teóricas, como os pré-conceitos sobre a falta de iniciativa dos setores públicos e números a respeito da morosidade do sistema judiciário brasileiro. A partir do capítulo seguinte foi desenvolvido e aplicado o método qualitativo para a pesquisa, buscando entender o atual cenário através das palavras de quem atua nele; sendo assim, foram entrevistados servidores que operam diretamente na cobrança de Dívida Ativa, interrogando num primeiro momento funcionários da Prefeitura de Osório e posteriormente colaboradores atuantes em Santo Antônio da Patrulha, município vizinho que já utiliza o sistema estudado. Por fim, através de tal investigação foi possível analisar com mais clareza o atual conteúdo, de onde se chegou à conclusão de que o sistema de cobrança cartorária é sim viável e de extrema necessidade hoje para o município de Osório.

The present paper aims to analyze the viability to implement the extra judicial charging system through the Tax Liability registry protests in Osório. As a first step, we tried to characterize the environment, describing the municipality reality features, to depict the relevance of that content in its ambit, as well as to identify the issue and set the research general and specific goals. In the second chapter the author of the research analyzed theoretical references which are able to enlighten the important points of the subject, investigating theoretical questions, such as pre concepts about the lack of public sectors initiative and numbers concerning the Brazilian Judicial System slowness. From the following chapter on, the qualitative method was developed and applied to the research on trying to understand the current scenery through the voice of the ones who work on it. For that, servers working directly with tax liability charge were interviewed. First, Osorio City Hall servers were interrogated, then working employees in Santo Antonio da Patrulha, the neighboring city which has already used the studied system. Finally, through this investigation it was possible to analyze the current content clearly and we draw the conclusion that this registry collection is feasible and extremely needed nowadays for the city of Osório.
