A (in)constitucionalidade do Art. 791-A, §4, da CLT à luz dos tribunais regionais do trabalho da 4ª, 14ª E 19ª regiões

Abstract

O presente trabalho visa a analisar o instituto da justiça gratuita no processo do trabalho, especialmente no que tange à inconstitucionalidade do art. 791-A, §4º, CLT, o qual impõe o pagamento de honorários de sucumbência aos beneficiários da justiça gratuita. Para tanto, a pesquisa está dividida em três momentos: o primeiro se reveste de uma preocupação com relação à previsão legal do instituto da justiça gratuita no sistema jurídico brasileiro, a fim de compreender a sua importância para o acesso à justiça por sujeitos hipossuficientes, bem como analisa a relação entre processo civil e processo do trabalho. Na segunda parte, apontam-se as alterações previstas pela Reforma Trabalhista em relação aos beneficiários da justiça gratuita no processo do trabalho, bem como discutem-se seus efeitos no ajuizamento de novas demandas. Por fim, parte-se para a questão principal da pesquisa, que está centrada na análise dos fundamentos utilizados pelos Tribunais Regionais do Trabalho da 4ª Região, 14ª Região e 19ª Região, os quais declararam a inconstitucionalidade do art. 791-A, §4º, CLT, de forma parcial ou total. O objetivo do trabalho é definir os institutos jurídicos que foram violados com a previsão da obrigação ao pagamento de sucumbência pelos beneficiários da justiça gratuita. Utiliza-se, para tanto, o método dedutivo, com análise da legislação, doutrina e jurisprudência. Por fim, os resultados obtidos demonstram que há violação de princípios constitucionais e de princípios do direito do trabalho na alteração legislativa.

The present work aims to analyze the establishment of free of charge justice in the labor proceedings, particularly with regard to the unconstitutionality of the article 791-A, §4º, CLT, which imposes the payment of compensation fees to the beneficiaries of free of charge justice. Therefore, this research is divided into three moments: in the first one, a concerning is acknowledged in relation to the legal prevision of the free of charge justice in the Brazilian juridical system, in order to comprehend its importance to the underprivileged subjects of accessing justice, as well as the connections between civil proceedings and labor proceedings are examined. In the second part, foreseen alterations by the Labor Reform regarding to the free of charge justice beneficiaries in the labor proceedings are pointed out, along with the discussion of its effects in the matter of the appraisal of new requests. Lastly, the main issue of this work is addressed, whereupon is centered on the analysis of the foundations applied by the Regional Labor Courts of the 4th Region (TRT4), 14th Region (TRT14), and 19th Region (TRT19), in which, partially or totally, the unconstitutionality of the article 791-A, §4º, CLT has been declared. The goal of this paper is to expound the juridical establishments that has been violated with the prevision of mandatory compensation payment by the free of charge justice beneficiaries. Thereunto, the deductive method is used, in addition to the analysis of the legislation, doctrine, and jurisprudence. Ultimately, according to the results obtained, it may be argued that there is a violation of constitutional principles and labor law principles.
