Tutela jurídico-penal dos animais ante a liberdade religiosa : o caso do sacrifício de animais no estado do Rio Grande do Sul

Abstract

O presente trabalho de conclusão de curso tem como propósito principal defender a aplicação dos princípios jurídicos-penais de proteção aos animais não humanos, no que se refere a manutenção da vida e a proibição dos maus tratos, frente aos rituais religiosos. Entende-se que o alijamento dos animais do círculo de consideração jurídico-moral decorre do especismo, que consiste na discriminação arbitrária de um ente apenas por não pertencer à espécie humana e isso faz com que a (pouca) proteção garantida aos animais diante de crimes, como o de maus tratos, seja banalizada frente aos interesses humanos. Para tanto, serão explicitados as relações morais e de direito entre humanos e não humanos, expondo-se a questão do antropocentrismo e do especismo. Será abordada a tutela garantida aos animais pela Constituição Federal do Brasil, assim como as garantias infraconstitucionais, enfatizando-se a proteção jurídico-penal e também as controversas leis que tratam da matéria no estado do Rio Grande do Sul. Também serão abordados os argumentos da ADI 70010129690 e também o projeto de Lei 21/2015, que visavam garantir a proteção aos animais frente a cultos religiosos. Será trazido a tona o questionamento se está a religião e seus cultos acima do valor da vida e da dor de um ser, seja ele da espécie que for. Conclui-se o presente trabalho demonstrando-se algumas decisões jurídicas sobre maus tratos aos animais.

This coursework has as main purpose to defend the application of the criminal-legal principles for the protection of non-human animals, as regards the maintenance of life and the prohibition of maltreatment, in the face of religious rituals. It is understood that the separation of the animals in the circle of legal and moral consideration arises of speciesism, which consists of arbitrary discrimination of an entity only for not belonging to the human species and this causes the (little) protection ensured to animals before crimes such as maltreatment, be trivialized in face of the human interests. For this, it will be explained the moral and legal relations between human and non-human, exposing the question of anthropocentrism and speciesism. It will be addressed the custody to animals by the Federal Constitution of Brazil, as well as subconstitutional guarantees, emphasizing the criminal legal protection and also the controversial laws that deal with the matter in the state of Rio Grande do Sul. Also the arguments of ADI 70010129690 an the draft Law 21/2015, aimed at ensuring the protection of animals in face of the religious cults will be addressed. It will be brought to the surface the question whether the religion and its services are above the value of life and pain of a being, be it the species it is. This paper is concluded showing up some legal decisions about maltreatment of animals.
