Condenações e condenados pelo crime de tráfico de drogas em Porto Alegre / RS : análise à luz da criminologia

Abstract

O presente trabalho pretende analisar as condenações e os sujeitos condenados pelo crime de tráfico de drogas em Porto Alegre/RS. A problemática foi desenvolvida em razão da hipótese apresentada pela doutrina da criminologia crítica e pela sociologia de que algumas pessoas são mais condenáveis do que outras, e que esta premissa permeia o imaginário do legislativo, dos agentes do poder punitivo e dos operadores jurídicos. Metodologicamente, foi utilizada revisão bibliográfica sobre a Lei nº 11.343/2006 e em relação às teorias criminológicas que se associam à temática. Houve também pesquisa quali-quantitativa por amostragem sobre a jurisprudência do Tribunal de Justiça do Rio Grande do Sul sobre os aspectos que envolvem o delito de tráfico de drogas. Assim, inicialmente são apresentadas as características do crime estudado e como foram desenvolvidas as políticas de combate às drogas na América, ao passo que simultaneamente se criou o estereótipo político-criminoso do traficante, para posteriormente se examinar como os sujeitos que correspondem a esse estereótipo se inserem no mercado ilícito dos entorpecentes Após, são feitas breves considerações sobre a dosimetria da pena nos crimes de tráfico de drogas, para melhor compreender os julgados que se analisa, os quais demonstram que os sujeitos que são imputados e condenados por tal delito pertencem a bairros em vulnerabilidade social em Porto Alegre, associando-se, portanto, aos conceitos de subcidadania, associação diferencial, subcultura, sujeição criminal e ao Direito Penal do inimigo. Conclui-se que a política criminal adotada na Lei de Drogas pode ser compreendida sob a ótica do labeling approach , visto que um de seus principais efeitos é a rotulação de determinados indivíduos. Os principais desdobramentos da política criminal adotada pela legislação são, em suma, a intensificação da marginalização social e da seletividade penal.

The present work intends to analyze the convictions and the subjects condemned by the crime of drug trafficking in Porto Alegre, RS. The problematic has been developed because of the hypothesis presented by the doctrine of critical criminology and sociology that some people are more culpable than others, and that this premise permeates the imaginary of the legislature, agents of punitive power and legal operators. Methodologically, a bibliographical review on Law number 11.343/2006 was used and in relation to the criminological theories that are associated to the thematic one. There was also qualitative and quantitative survey on the case law of the Court of Justice of Rio Grande do Sul on the aspects that involve the crime of drug trafficking. Thus, initially the characteristics of the crime studied and how the drug policies in the Americas were developed, while at the same time creating the political-criminal stereotype of the trafficker, we then examine how the subjects that correspond to this stereotype the illicit market for narcotics. Afterwards, brief considerations are made on the dosimetry of punishment in drug trafficking crimes, in order to better understand the judgments analyzed, which demonstrate that the subjects who are charged and convicted of such offense belong to socially vulnerable neighborhoods in Porto Alegre, associating, therefore, with the concepts of sub-citizenship, differential association, subculture, criminal subjection and the Criminal Law of the enemy. It is concluded that the criminal policy adopted in the Drug Law can be understood from the point of view of the labeling approach, since one of its main effects is the labeling of certain individuals. The main developments of the criminal policy adopted by the legislation are, in short, the intensification of social marginalization and criminal selectivity.
