Efeitos da reforma trabalhista sobre os institutos da justiça gratuita e assitência judiciária gratuita

Abstract

O presente trabalho trata dos efeitos da Lei nº 13.467/17, a chamada Reforma Trabalhista, sobre a Assistência Jurídica Gratuita, mais especificamente nos institutos da Justiça Gratuita e da Assistência Judiciária Gratuita. O problema de pesquisa proposto é identificar quais os efeitos da Reforma Trabalhista sobre os institutos da Justiça Gratuita e Assistência Judiciária Gratuita. Para enfrentar o problema exposto, aborda-se o acesso à justiça enquanto direito fundamental e os princípios da igualdade, do contraditório, da ampla defesa e da proteção ao trabalhador, sendo, então, o direito à assistência jurídica gratuita integral apresentado enquanto forma de promoção do acesso à justiça, fazendo-se uma diferenciação conceitual entre o gênero assistência judiciária e as espécies da justiça gratuita e da assistência judiciária gratuita. Em seguida, cada um dos institutos é conceituado, sendo exposta a normatização anterior à Reforma Trabalhista e a alteração sofrida, expondo-se, por fim, o estado atual de aplicabilidade das normas advindas da Lei 13.467/17 sobre os institutos em estudo, no âmbito do TRT da 4ª Região Utiliza-se o método de abordagem dedutivo, empregando majoritariamente as técnicas de pesquisa de revisão bibliográfica, com estudo do tema a partir de fontes primárias como obras jurídicas, teses e artigos e a jurisprudencial, investigando-se precedentes judiciais e legais, em uma análise qualitativa. Conclui-se, então, que a Lei nº 13.467/17 introduziu normas que importaram em alterações consideráveis no processo trabalhista, as quais, apesar de aproximar o processo do trabalho do processo civil em certos aspectos, o que seria desejável, acabam por obstaculizar o acesso à Justiça, em dissonância da previsão constitucional. Não tendo o presente estudo a pretensão de esgotar o tema, que é novo e controvertido, sugere-se novas investigações, no sentido de acompanhar como o tempo sedimentará as questões ora ensejadoras de muita divergência.

This senior thesis discusses the effects of Law 13.467/17, hereby named Labour Reform, regarding free legal aid – specifically, the institutes of free justice and free legal aid. The research problem involves identifying which are the effects of said reform upon the aforementioned institutes. In order to answer the proposed problem, the rights of accessing the justice system, equality, to adversary proceedings, defence and worker protection. The right to full and free legal aid is presented as a promotion of the right of accessing the justice system. It is then necessary to outline differences between the concepts of legal assistance and the types of free justice and free legal aid. Following this, each of the aforementioned institutes is conceptualized, and the norms before the Labour Reform are exposed, as well as are the current state of applicability of the norms in Law 13.467/17 under the Regional Labour Court of the 4th Region in Brazil (TRT4). The deductive approach is the choice method, mainly employing research techniques of literary review, using legal works, thesis, articles and jurisprudence texts and investigating precedents in a qualitative analysis. It is then concluded that Law 13.467/17 introduced norms that made sensitive changes in the labour proceedings. These changes, even though they bring labour proceedings closer to civil proceedings in certain aspects, which is desirable, end up creating obstacles for the access to justice, contradicting the constitutional prediction. The present study does not aim at discussing every aspect of this theme, which is new and controversial, but suggests new investigations as to follow up on how time will solidify the questions now met with great disagreement.
