A contribuição brasileira para o regime internacional de solução de controvérsias de investimento

Abstract

O presente trabalho tem como objetivo analisar qual a contribuição do Brasil para o regime internacional de solução de controvérsias de investimento, atentando à análise histórica da consolidação do regime internacional do investimento na geração TBI, dos métodos de solução de controvérsias mais proeminentes e do posicionamento brasileiro no tempo até a assinatura do novo modelo de Acordo de Cooperação e Facilitação do Investimento (ACFI). O estudo mostra a evolução do regime de investimentos internacional e as mudanças na conjuntura contemporânea, as quais revolucionaram as relações tradicionais entre os países desenvolvidos e em desenvolvimento; bem como o posicionamento brasileiro frente a essas mudanças que, acompanhando esse novo cenário, adotou um modelo contemporâneo de ACFI cujo foco é a prevenção de disputas e a solução dos conflitos de forma diplomática. Assim, a ratificação de acordos de investimento é alternativa importante diante da instabilidade experienciada por investidores brasileiros no exterior e enriquecedora ao debate sobre novos caminhos ao atual regime internacional de solução de controvérsias sobre investimento. Neste diapasão, o método utilizado foi o dedutivo, a partir de extensa revisão bibliográfica e análise comparativa de TBI’s selecionados.

The present study aims to analyse the contribution of Brazil to the international regime of investment dispute resolution. Bearing in mind the historical analysis of the consolidation of the international investment regime in the BIT generation, the most proeminentes methods of investment dispute resolution, and the brazilian political position in time till the signing of the new model of Agreement on Cooperantion and Facilitation of Investments (ACFI). The research shows the evolution of the international investment regime and the changes in the contemporary situation, wich revolutionized the traditional relations between developed and developing countries; as well as Brazil’s position in light of these changes wich, in acordance with this new scenario, adopted a contemporary model of ACFI, focused on the prevention of disputes and the diplomatic resolution of conflicts. Therefore, the ratification of investment agreements is an important alternative in the face of the instability experienced by brasilian investors overseas and enriching to the debate about new paths to the current international regime of investment dispute resolution. In this sense, the research method used was the deductive, through an extensive bibligraphic review and the comparative analysis of selected BIT’s.
