Avalia todos os reflexos jurídicos no âmbito internacional gerados pela descoberta da embarcação naufragada RMS Titanic, no ano de 1985. É uma pesquisa de análise qualitativa de dados. Disserta sobre a relevância do naufrágio e da descoberta da sua estrutura, 70 anos depois do incidente, os interesses privados e os públicos existentes sobre o navio na sociedade mundial, as normas legais internacionais que embasam estes interesses, além das consequências jurídicas reais. Conclui que os dois interesses foram combinados e impostos por decisões judiciais emitidas pela District Court of Virginia e pela United States Court of Appeals, 4th Circuit, considerando importante tanto a preservação dos bens, mas, igualmente, do seu salvamento. Expõe a predominância da preservação fora d’agua e de métodos de restauração, e a necessidade de tecnologias cada vez mais avançadas para realização dos processos impostos pela jurisdição norte-americana. Finaliza apontando que o navio fora amplamente explorado desde o seu descobrimento, mas que o seu valor histórico não se perdeu até hoje. ...
Abstract
It evaluates all the international legal results produced by the discovery of the wreck of the RMS Titanic in 1985. It is a research of analysis of data qualitative. It describes the significance of the wreck and its discovery, 70 years later, the private interests and the public interests about the wreck in the world society, the international statements as well as the real implications in the judicial sphere. It evaluates all the international legal results produced by the discovery of the wreck of the RMS Titanic in 1985. It is a research of analysis of data qualitative. It describes the significance of the wreck and its discovery, 70 years later, the private interests and the public interests about the wreck in the world society, the international statements as well as the real implications in the judicial sphere. It concludes that the both interests were combined and imposed by the District Court of Virginia and United States Court of Appeals, 4th Circuit, considering the need of preservation but the salvage of the artifacts. It sets out the prevalence of the preservation out of water with recovery of the items and the necessity of advanced technologies for all the judicial orders. Finally, although the wreck site of the RMS Titanic has been scrutinized, its historic value remains alive. ...
