O regime da coisa julgada nos processos coletivos sob o influxo da representatividade adequada

Abstract

O objetivo do presente trabalho é a análise do regime da coisa julgada nas ações coletivas à luz do instituto da representatividade adequada, de modo a contribuir para a maior efetivação dos direitos transindividuais e individuais homogêneos no ordenamento jurídico brasileiro. Em breve estudo, procurou-se definir, caracterizar e elucidar a coisa julgada, a legitimidade extraordinária e a representatividade adequada, no âmbito das ações coletivas. Pretendeu-se demonstrar que o instituto da representatividade adequada é essencial para tornar efetivo os processos coletivos sem, contudo, violar qualquer direito constitucional e processual. Se a legitimação nas demandas coletivas for aferida pelo magistrado casuisticamente, em relação aos entes taxativamente previstos em lei, não haverá motivos para a coisa julgada não alcançar quem não foi parte no processo. Assim, buscou-se evidenciar os reflexos da representatividade adequada no processo coletivo com relação à extensão da coisa julgada, de forma a assegurar o devido processo legal e a segurança jurídica nas relações coletivas.

This study aims to analyze the regime of class actions’ res judicata in light of the adequacy of representation, in order to contribute to the best execution of the transindividual rights and homogeneous individual rights protection in the Brazilian legal system. Starting from this review, this work sought to define, characterize and elucidate the res judicata, the extraordinary legitimacy and the adequacy of representation within the scope of the class actions. The intent is to demonstrate that the adequacy of representation is essential to the best execution of the collective process, without, however, breaching constitutional and procedural law. If the legitimacy in the class action is analyzed case by case by the court, in relation to the suitable entities listed at the exhaustive list provided by law, there will be no motives for the res judicata fail to achieve anyone who is not part in the process. Thus, the study also sought to show the consequences of the adequate representation to the collective process, according to the res judicata limits, aiming to ensure the due process of the law and the legal certainty in collective relations.
