Linchamentos na contemporaneidade : observações sobre a complexidade de suas causas,motivações e sujeitos

Abstract

Este trabalho propõe o estudo de uma das formas mais frequentes de violência coletiva no Brasil, os linchamentos, à luz dos dados observados por José de Souza Martins em 2.028 casos ocorridos no Brasil nos últimos 60 anos. O problema levantado pela pesquisa busca compreender se as complexas causas e motivações envolvidas em um linchamento guardam algum tipo de similaridade com elementos do direito penal. Para isso, levantam-se questionamentos sobre se há alguma semelhança entre as motivações dos linchamentos e as justificações das teorias da pena; nesse mesmo sentido, procura-se compreender se é possível identificar pontos de encontro entre os sujeitos selecionados pelas multidões linchadoras e os sujeitos selecionados pelo sistema penal. A hipótese é de que, a partir do entendimento da pena como uma violência institucionalizada, haveria semelhanças entre os casos observados e as justificações retributivas e da prevenção especial negativa da pena. Assim, também, haveria uma identidade entre os sujeitos vítimas da violência do Estado e aqueles sujeitos vítimas da violência coletiva na forma dos linchamentos. As observações tomaram como ponto de partida a separação entre teorias absolutas e teorias relativas da pena, apontando as principais diferenças entre as duas grandes correntes. Em um segundo momento, entendeu-se inescusável a compreensão de que a pena, como instituição violenta que é, seleciona sistematicamente um tipo determinado de sujeito. A partir dessas primeiras abordagens, intentou-se desvendar a dinâmica dos linchamentos ocorridos no país a partir da ótica de Martins, aplicando, ulteriormente, algumas de suas constatações ao estudo de casos, que tratou de 13 ocorrências de linchamentos, noticiadas pelos três principais jornais do Rio Grande do Sul, Zero Hora, Diário Gaúcho e Correio do Povo, entre os anos de 2015 e 2017, com observações a respeito da complexidade de suas causas, das semelhanças percebidas entre as suas motivações e justificações e as justificações das teorias da pena, além da identificação da possível identidade entre os sujeitos selecionados pelo sistema penal e os sujeitos linchados. Como conclusão parcial, tem-se que os linchamentos, como tema geral e os casos observados, como tema específico, são multifatoriais e não conseguem ser explicados considerando apenas uma variável. Nesse sentido, não é apenas a natureza do crime, a imagem do sujeito ou o meio em que ele ocorre que determinam a ocorrência de um linchamento, mas uma combinação complexa de fatores, algumas vezes juntos, outras separados. Além disso, constata-se que a hipótese inicial é parcialmente verdadeira, com semelhanças importantes entre a face retributiva da pena e as motivações de um linchamento; da mesma forma, consigna-se a existência de pontos de identidade importantes entre os sujeitos selecionados pelo sistema penal e aqueles mais propensos a serem linchados com maior violência em uma ocorrência de linchamento.

This Research proposes to study one of the many frequente ways of collective violence in Brasil, the lynching, in light of data observed by José de Souza Martins in 2.028 cases that occurred in the last 60 years in Brasil. The issued problem by this research searches the comprehend its complex causes and also motivations that allow the involvement in the lynching and that they hold some similarity with the elements to the criminal law. As for that, questionings concerningif there is a similarity between the motivations of the lynching and the justifications in the criminal theories; at the same time, it is asked if its possible to identify common points between the selected subjects to the lynching parties and the subjects of the criminal system. The hypothesis is that, understanding the punishment as a institutionalized violence, there should be similarities between the observed cases and the retributive justifications and the negative especial prevention of the punishment. Therefore, also, there would be collective violence in these forms of lynching. The observations took the starting point the separation in the absolute theories and the relative theories of punishment, pointing that the main differences between the two main currents. In a second moment, its understood its inexcusable the understanding that the punishment, as violent as the institution is, selects sistematically a determined kind of subjects. Thus from these approaches, it was intended to unravel the dynamic of the lynching that occurred in this country in the otic of Martins, applying, subsequently, some of its findings in the study of these cases, 13 occurrences of lynching in total, notified by three main newspapers in Rio Grande do Sul, Zero Hora, Diário Gaúcho and Correio do Povo, between the years of 2015 and 2017, with observations about the complexity of the cases and its causes, from the resemblances perceived between the motivations and justifications in the theories of law, also the identification of the possible identity of the selected subjects by the criminal systems and the lynched subjects. The partial conclusion is that lynching, as a broad term and the observed cases, as a specific subject, are multifactorial and cannot be explained considering just one variable. In this sense, it is not the nature of the crime, image of the subject or the environment that it occurs that determine these happenings of a lynching, but the combined complexity of factors, sometimes together, sometimes separate. Likewise, the initial hypothesis has proven to be partially true, with importante similarities between the retributive side of the punishment and the motivations of a lynching; thus far, it is consigned the existence of importante identity points between the subjects selected by the criminal system and the more likely subjects to be lynched with more violence in the occurrence of a lynching.
