O presente trabalho versa sobre a legitimidade democrática das decisões judiciais proferidas pelas jurisdições constitucionais. O tema mereceu a atenção de importantes filósofos e teóricos do direito, que há tempo questionam se as jurisdições constitucionais são compatíveis com o regime democrático, já que são as responsáveis por, eventualmente, invalidar atos normativos que com ela não se harmonizem. No presente estudo, parte-se da perspectiva de que texto normativo e norma não se confundem: a norma é resultado da interpretação realizada nos órgãos jurisdicionais, sendo que essa atividade interpretativa deve estar justificada na decisão judicial. Essa justificação, somada à viabilização de ampla participação social nos processos judiciais, é o que permite que toda e qualquer decisão judicial – inclusive do Supremo Tribunal Federal – seja legítima. São as práticas do STF, e não a sua natureza, que podem, ou não, ser compatíveis com a democracia. Em síntese, a legitimidade democrática das decisões do STF é um problema específico que se situa no seio de um problema mais amplo, qual seja, o da legitimidade das decisões judiciais. O controle da justificação dessas decisões e a participação da sociedade civil em tais processos podem ser viabilizados por instrumentos processuais de inegável relevância, tais como a intervenção do amicus curiae e a realização de audiências públicas, capazes de pluralizar e democratizar as práticas do Supremo Tribunal Federal. Essa potência será demonstrada ao longo do trabalho. Uma análise atenta dos autos do Recurso Extraordinário número 841.526/RS, no entanto, demonstra que o Supremo Tribunal Federal ainda precisa evoluir para fazer jus ao slogan de abertura que costuma sustentar por conta da admissão de terceiros interventores nos processos. ...

This paper deals with the democratic legitimacy of the judicial decisions handed down by the constitutional jurisdiction. The subject has attracted important philosophers and law theorist’s attention, who have long questioned whether constitutional jurisdictions are compatible with the democratic regime, given that they have the power, eventually, to invalidate normative acts. In the present study, in a different way, one starts from the perspective that normative text and norm are not the same: the norm is the interpretation results, made in the jurisdictional organs, being that this interpretative activity must be justified in the judicial decision. This justification, together with the viability of a broad social participation in judicial proceedings, is what allows any judicial decision – including the Supremo Tribunal Federal decisions – to be legitimate. In short, the democratic legitimacy of STF decisions is a specific problem that lies within a broader problem, that is, the problem of the judicial decisions legitimacy. The decisions justification control and the civil society participation in such processes can be made possible by procedural instruments of undeniable relevance, such as amicus curiae and public hearings, capable of pluralizing and democratizing the Supremo Tribunal Federal practices. This power will be demonstrated throughout the work. An attentive analysis of Appeal number 841.526/RS demonstrates, however, that the Supremo Tribunal Federal has yet to evolve to account for the opening slogan that it usually supports due to the admission of third-parts in the procedures. ...
