O regime das incapacidades à luz da lei 13.146/15 e seus reflexos de família

Abstract

A presente monografia tem por objetivo analisar os efeitos da introdução da Lei 13.146 no ordenamento jurídico brasileiro, relativamente ao regime jurídico das incapacidades civis e seus desdobramentos no Direito de Família. A Lei de Inclusão da Pessoa com Deficiência trata-se de um marco no processo histórico por reivindicação de direitos das pessoas com deficiência e, por isso, deve ser examinada considerando-se o contexto em que foi elaborada. O atual estágio de desenvolvimento dos direitos desses seres humanos caracteriza-se pela afirmação de sua dignidade humana, autonomia, não discriminação e igualdade perante os demais indivíduos. Sob esse enfoque que a pesquisa realizada procurou examinar as mudanças ocorridas no regime das incapacidades.

This monograph aims to analyze the effects of the introduction of Law 13,146 in the Brazilian legal system, regarding the legal regime of disabilities and their unfolding in Family Law. Brazilian Law Inclusion of Persons with Disabilities is a landmark in the historical process for claiming rights of person with disabilities and, therefore, must be examined considering the context in which it was drafted. The current stage of development of the rights of these human beings is characterized by the affirmation of their human dignity, autonomy, non-discrimination and equality with other individuals. Under this approach, the research carried out looked at changes in the disability regime.
