Os modelos de tomada de decisão seriatim e per curiam serão apresentados para constatar de que maneira a adoção de cada um deles pode ajudar a solucionar o problema. O trabalho trata do problema da formação de precedentes nas cortes supremas. Os modelos de tomada de decisão seriatim e per curiam serão apresentados para constatar de que maneira a adoção de cada um deles pode ajudar a solucionar o problema. Uma vez que o método de tomada de decisão majoritário integra os dois modelos, os aspectos desse procedimento também serão constatados. Para identificar os efeitos da importância da adoção dos diferentes sistemas, são delineadas as características dos precedentes e os benefícios trazidos por eles ao sistema jurídico. Haverá a apresentação de casos julgados pelo Supremo Tribunal Federal e pela Supreme Court estadunidense para auxiliar na identificação das vantagens e desvantagens do uso de cada sistema. ...

The work addresses the problem of the formation of precedents in the supreme courts. The seriatim and per curiam models of decision-making are analyzed to verify how the adoption of each of them could help to solve the problem.
