Antártica : proteção no direito ambiental internacional e partipação brasileira

Abstract

O presente estudo trata da proteção da Antártica, dentro do Sistema do Tratado Antártico. Busca-se apresentar a Antártica em seus constituintes geológicos, recursos naturais, sua importância para o planeta, o processo histórico de conquista de seu território, e o processo de constituição de seu regime jurídico. É objeto de análise as questões sobre o aquecimento global, seu impacto sobre a Antártica e o que tem a contribuir os países e o Direito Ambiental Internacional, especialmente, sobre o legado de ambiente saudável e equilibrado para futuras gerações. Também, se traz ao contexto, a participação brasileira, sua importância no desenvolvimento da pesquisa científica na Antártica e no que auxilia na proteção da Antártica. Nesse contesto, pretende responder se a proteção da Antártica, pelo regime jurídico aplicado em sua preservação, cumpre seus objetivos e princípios viabilizando a proteção efetiva do meio ambiente antártico frente às questões ambientais globais da atualidade, visando assegurar um ambiente saudável e equilibrado às futuras gerações. Para tanto, buscou-se na pesquisa de literatura sobre a Antártica, copilando estes assuntos O que, permitiu concluir que o Sistema do Tratado Antártico cumpre seus objetivos e princípios na preservação da Antártica para fins pacíficos e cooperação científica e na regulamentação de atividades dentro da área de aplicação do seu regime jurídico. No entanto, identifica-se a necessidade de maior cooperação entre os países na proteção ambiental global, com vista às futuras gerações, em virtude da identificação de impactos ambientais na Antártica ocorridos pelo aquecimento global provocado pela emissão de gases que provocam o efeito estufa. A importância do Brasil é demonstrada por sua atuação ativa e permanente na Antártica, podendo atuar como fiscalizador no cumprimento do Sistema do Tratado Antártico.

This study deals with the protection of Antarctic within the legal system applied to the Antarctic territory, consisting of the Antarctic Treaty, drawn up in 1959, and its developments to the Madrid Protocol of 1991. It aims to present the Antarctic in its geological components, resources natural, its importance for the planet, the historical process of conquest of its territory, and the process of establishment of their legal status. It is analyzed in the issues of global warming, its impact on Antarctic and what have to contribute countries and the International Environmental Law, especially on the legacy of healthy and balanced environment for future generations. Also, it brings context, the Brazilian participation, their importance in the development of scientific research in Antarctic and which assists in the Antarctic protection. In this contest, aims to respond to the protection of Antarctic, the legal regime applied to its preservation, fulfills its objectives and principles enabling the effective protection of the Antarctic environment facing the global environmental issues of today, in order to ensure a healthy and balanced environment for future generations Therefore, searched on literature about Antarctica, compiling these issues. What, it concluded that the Antarctic Treaty System fulfills its objectives and principles for the preservation of Antarctica for peaceful purposes and scientific cooperation and regulatory activities within the area of application of their legal regime. However, it identifies the needs for greater cooperation on global environmental protection, with a view to future generations, because of the identification of environmental impacts in Antarctic occurred by global warming caused by the emission of gases that cause greenhouse effect. The importance of Brazil is demonstrated by its active and permanent presence in Antarctic, and may act as a surveyor in the line of the Antarctic Treaty System.
