Direito à identidade cultural : perspectivas a partir do caso Raposa Serra do Sol

Abstract

Este trabalho de conclusão de curso de graduação apresenta o direito à identidade cultural, em crescente demanda na sociedade, devido à intensificação das relações sociais promovidas pela globalização. Considera-se que este direito envolve a superação das situações de exclusão de indivíduos e grupos sociais, garantindo a estes agentes a autonomia e possibilidade de manutenção de sua singularidade cultural. Como exemplo deste direito, se aborda a questão indígena no Brasil, identidade cultural étnica presente desde a fundação do país, culminando nos direitos conquistados pela Constituição Federal promulgada em 1988. Após o exame histórico, analisa-se o julgamento envolvendo o caso da Terra Indígena Raposa Serra do Sol em 2009, o qual assegurou o direito cultural dos indígenas à terra, apontando perspectivas para novas situações.

This work of completing undergraduate course presents the right to cultural identity, in growing demand in society, due to the intensification of social relations promoted by globalization. It is considered that this right involves the overcoming of the excluding situations of individuals and social groups, ensuring these agents autonomy and the possibility of maintaining their cultural uniqueness. As an example of this right, the indigenous issue in Brazil, ethnic cultural identity present since the founding of the country, culminating in the rights won by the Federal Constitution promulgated in 1988. After the historical survey, the work analyzes the trial involving the case of the Indigenous Land Raposa Serra do Sol in 2009, which ensured the cultural rights of indigenous to land, pointing prospects for new situations.
