dc.description.abstractO objeto do presente trabalho é demonstrar a responsabilidade na esfera político-administrativa dos Governadores dos Estados e o Distrito Federal frente a concessão unilateral de benefícios fiscais no âmbito do ICMS, ação que induz à “guerra fiscal”. Para tanto, procurou-se delimitar o tema em questão, demonstrando os vários fatores da concessão unilateral, desde os preceitos que figuram na Constituição Federal e mais especificamente na Lei Complementar nº 24/1975, até a compreensão jurisprudencial, conforme o Supremo Tribunal Federal. Analisou-se ainda, os principais impactos negativos da “guerra fiscal” e alguns dos motivos de sua manutenção, dentre eles, a impunidade aos Governadores que afrontam a Constituição Federal. Analisado o contexto fático da “guerra fiscal”, partiu-se para a análise da responsabilidade político-administrativa dos chefes de governo estadual. Ao confrontar a concessão inconstitucional de benefícios fiscais e os ilícitos previstos na Lei nº 1.079/1950, apresentam-se as conclusões que os limites do estudo permitiram que fossem alcançadas.pt_BR
dc.description.abstractThe object of this article is to demonstrate the responsibility in the political and administrative area of the governors of the states (and of the federal district) face to the unilateral grant of tax benefits of the ICMS, action that induces the “fiscal war”. For this purpose, we tried to define the problem, showing the various factors of unilateral concession, from the precepts contained in the Federal Constitution and more specifically in Complementary Law nº 24/1975, until the understanding jurisprudential, as the Supreme Court. Was also analyzed, the main negative impacts of the "fiscal war" and some reasons for their maintenance, among them, the impunity of the state Governors that confront the Federal Constitution. Analyzed the factual context of the “fiscal war”, started the analysis of political and administrative responsibility of the state government heads. Confronting the unconstitutional granting tax benefits and illicit foreseen by Law 1.079/1950, presents the conclusions that the study limits allowed that were achieved.en
