Terrorismo na América Latina efeitos das transições democráticas sobre o conceito de terrorismo em uma perspectiva comparada entre Brasil, Argentina e Peru

Abstract

Este trabalho tem por objetivo determinar se os discursos sobre terrorismo, no âmbito jurídico latino-americano, mantêm a semântica de Segurança Nacional mesmo após a retomada das democracias. Partindo de um ponto de vista da Justiça da Transição, pretende analisar de que forma o sucesso em tais processos afeta os discursos jurídicos sobre terrorismo, por meio da análise de jurisprudência e legislação de países latino-americanos selecionados, em um estudo comparado entre Argentina, Brasil, Peru. Pertinente tal investigação devido à persistente utilização da legislação de Segurança Nacional no Brasil e de que tramitam perante o legislativo brasileiro propostas de novas tipificações de crimes de terrorismo.

This work aims to ascertain if the discourses on terrorism in Latin-American legal spheres still retain National Security Doctrine semantics, even after the resumption of democracies. Starting from a Transitional Justice viewpoint, it seeks to analyze in which way the success at such processes affects the legal discourses on terrorism, trough an analysis of selected Latin-American countries' legislation and jurisprudence, in a comparative study between Argentina, Brazil and Peru. This investigation becomes pertinent because of the persistent use of national security legislation in Brazil, and of new terrorism crime typifications that are in progress in the Brazilian legislature.
