O transgênero e o gênero não-binário no sistema penal : sua convergências, influências e problematizações

Abstract

Essa pesquisa visa analisar a forma com que o sistema penal reage quando indivíduos transgêneros se veem como vítimas, suspeitos ou condenados de práticas ilícitas, considerando as políticas criminais dos três poderes ao elaborar a legislação, investigá-los, sentenciar os processos de que são parte, e proceder a execução de suas penas. Foram feitas análises com base na legislação penal e sua interpretação doutrinária e judicial, buscando fragmentos jurídicos que pudessem ser lidos como partes do sistema que absorveram características particulares da população transgênera. Outrossim, levou-se em consideração as posições dos operadores do poder executivo em seus encontros com indivíduos transgêneros que se viram envolvidos no sistema penal. Buscou-se escrutinar como cada um dos três poderes lida com diversidades de performance gênero. Através disso, formou-se um panorama sobre a forma com que o Estado, através do sistema penal, dialoga com identidades de gênero não-clássicas.

This research intends to analyze how the penal system reacts when transgender individuals find themselves as victims, suspects or convicted of illegal activities, considering the criminal policies placed by the three branches of power in the writing of the legislation, the investigation and ruling of the actions they are part of, and the execution of their sentences. Analyses were made based on the criminal legislation e its doctrinaire and judicial interpretation, seeking legal fragments that could be read as pieces of the system that have absorbed the singular characteristics of the transgender community. Furthermore, the research took in consideration the agents of the executive power’s postures in their encounters with transgender individuals involved with the criminal system. The quest sought to scrutinize how each one of the three branches of power handles gender performance diversity. Thereby, it built an outlook about how the State, through the criminal system, dialogues with non- classic gender identities.
