A evolução da negociação coletiva no setor público : construção do processo regulatório e sua eficácia

Abstract

Verificou-se a evolução do processo de negociação coletiva no setor público, apesar da omissão legislativa que contemplou apenas o direito de greve e de associação sindical aos servidores. Os processos de negociação foram ganhando eficácia jurídica sem macular os princípios da Administração Pública, em resposta à imperativa dinâmica social. O próximo passo é a regulamentação da negociação coletiva e tratamento dos conflitos no setor público, que está sendo escrita tendo como retaguarda a Convenção 151 da OIT (Organização Internacional do Trabalho), recentemente ratificada pelo Brasil e que o vincula. A proposta do estudo é fazer uma crítica à eficácia desse processo regulatório ao não contemplar mecanismos céleres e efetivos, para a resolução de conflitos oriundos da recusa em negociar, do impasse na negociação, ou do não cumprimento do acordado.

There was progress in the process of collective bargaining in the public sector, despite of the legislative omission that has only the right to strike and form trade unions to the servers. The negotiation process was gaining legal effect without tarnishing the principles of public administration, and in response to compelling social dynamics. The next step is the regulation of collective bargaining and handling of conflicts in the public sector, which is being written with the rear as the Convention 151 of ILO (International Labour Office), recently ratified by Brazil and the links. It is proposed the study to make a complaint regarding the effectiveness of the regulatory process that it does not include mechanisms for swift and effective resolution of conflicts arising from the refusal to deal, the impasse in negotiations, or the breach of agreement.
