O papel dos burocratas de médio escalão na implementação da lei da liberdade econômica : um estudo de caso no Município de Campo Bom/RS

Abstract

Este trabalho dissertativo é contextualizado no âmbito da implementação da Lei da Liberdade Econômica, que estabelece normas de proteção à livre iniciativa e ao livre exercício de atividade econômica, tendo como recorte de abrangência o município de Campo Bom, no Rio Grande do Sul. Partindo do constructo teórico sobre políticas públicas, implementação de política pública e atuação dos burocratas de médio escalão, a pesquisa buscou compreender o papel e a influência desempenhados pela burocracia de nível intermediário na implementação da Lei no município. Como objetivos específicos, buscou-se identificar e traçar o perfil dos burocratas que atuaram na implementação; examinar a trajetória da legislação e o papel desses burocratas no processo; verificar como esses atores mobilizaram os aprendizados, conhecimentos técnicos e a experiência como fatores de influência; analisar como se conformam os processos internos que orientam a fiscalização das pessoas jurídicas beneficiadas pela implementação da lei. Para isso, a abordagem metodológica escolhida foi a qualitativa, tendo como estratégia o estudo de caso, com o uso de técnicas de pesquisa documental e entrevistas semiestruturadas. Como principais resultados, o estudo evidenciou que o conhecimento técnico especializado, aliado à experiência no trabalho de campo e ao protagonismo dos burocratas de médio escalão, apresentaram-se como fatores influenciadores do processo decisório que envolveu a implementação da Lei no município. Além disso, os burocratas de nível intermediário demonstraram sua importância no processo das políticas públicas, com suas habilidades de diálogo técnico e político com a burocracia de alto escalão, atuando como implementadores e policymakers simultaneamente.

This dissertation paper is contextualized within the framework of the implementation of the Economic Freedom Law, which establishes norms for the protection of free initiative and the free practice of economic activity, having as scope the municipality of Campo Bom, in Rio Grande do Sul, Brazil. From the theoretical construct on public policies, the implementation of public policy and the operation of middle-ranking bureaucrats, the research sought to understand the role and influence performed by intermediary-level bureaucracy in the implementation of the Law in the municipality. As specific goals, it was sought to identify and determine the profile of bureaucrats who acted in the implementation; to examine the trajectory of the legislation and the role of these bureaucrats in the process; to verify how these actors mobilized learning, technical knowledge and the experience as influencing factors; to analyze how the internal processes that guide the inspection of legal entities benefited by the implementation of the law conform. To this end, the chosen methodological approach was the qualitative one, having the case study as a strategy, with the use of documental research techniques and semi-structured interviews. As main results, the study has shown that specialized technical knowledge, combined with experience in field work and the protagonism of middle-ranking bureaucrats, present as influencing factors in the decision-making process that involved the implementation of the Law in the municipality. Furthermore, the intermediarylevel bureaucrats proved their importance in the public policy process, with their technical and political dialogue skills to the high-ranking bureaucracy, acting as implementers and policymakers simultaneously.
