A modulação de efeitos temporais no controle de constitucionalidade

Abstract

O presente estudo tem como objetivo principal a análise da modulação de efeitos temporais no controle de constitucionalidade, tema que ganha relevância a partir da Lei nº 9.868/99. O estudo se inicia pelos principais modelos de controle de constitucionalidade (judicial review, austríaco e francês) e suas influências no modelo brasileiro. A seguir, em um breve relato, será examinada a evolução do controle de constitucionalidade através das Constituições brasileiras. Após, serão revisitados alguns conceitos fundamentais para a melhor compreensão do tema e, por fim, serão examinados alguns precedentes do Supremo Tribunal Federal. Com tal abordagem, pretende-se demonstrar que a modulação de efeitos temporais no controle de constitucionalidade não fere a supremacia da Constituição, uma vez que a ponderação se dá entre as normas que protegem os efeitos produzidos pelo ato inconstitucional em confronto com a norma por ele violada. Assim, em nome de valores como boa-fé, justiça e segurança jurídica, é possível suprimir ou atenuar o caráter retroativo do pronunciamento de inconstitucionalidade

This study aims to analyze the temporal modulation effects on the constitutionality control, an issue that becomes relevant from the Law 9868/99. The study begins by leading constitutional control models (judicial review, Austrian and French) and their influences on the Brazilian model. Then, in a brief report will examine the evolution of judicial review by the Brazilian Constitutions. After, they will be revisited some fundamental concepts for a better understanding of the issue and, finally, will be examined some precedents of the Supreme Court. With this approach, we intend to demonstrate that modulation of temporal effects in the judicial review does not violate the supremacy of the Constitution, since the weight is between the rules that protect the effects produced by the unconstitutional act at odds with the norm for him violated. So, in the name of values such as good faith, justice and legal certainty, it is possible to eliminate or mitigate the retroactive nature of the unconstitutionality statement.
