Padrões de recrutamento das desembargadoras do Tribunal de Justiça do Rio Grande do Sul

Abstract

Esta pesquisa tem como objeto a análise dos padrões de recrutamento das desembargadoras do Tribunal de Justiça do Rio Grande do Sul que ascenderam ao cargo entre 1998 e 2018, e estavam em atividade nos meses de março, abril e maio de 2019. Para tanto, o trabalho divide-se em três partes. Inicialmente, cuida-se de apresentar o enquadramento teórico-metodológico do estudo, alicerçado na abordagem sociopolítica das instituições judiciais. Em seguida, trata-se da delimitação e da relevância do tema a partir de levantamento bibliográfico acerca das formas de recrutamento de elites, bem como do processo de diversificação do espaço jurídico no Brasil, com ênfase em estudos sobre as práticas e representações suscitadas pelo ingresso de mulheres na carreira da magistratura. De conseguinte, apresenta-se a compilação do material coletado, ou seja, as observações de campo e as entrevistas concedidas pelas desembargadoras, a fim de identificar possíveis padrões e percursos comuns às mulheres que ascenderam à posição de desembargadoras. Com isso, objetiva-se avançar na apreensão sobre o recrutamento desta parcela da elite jurídica e sua relação com o processo de diversificação do espaço jurídico no contexto de uma dinâmica social e política representada pelo ingresso de mulheres no grau mais elevado da carreira da magistratura estadual sul-rio-grandense.

The purpose of this study is to analyze patterns in the recruitment of female appeals court judges for the Court of Justice Rio Grande do Sul who took office between the years of 1998 and 2018, and had been actively working during the months of March, April and May of 2019. In order to do so, the paper is divided in three parts. First, it presents the theoretical and methodological perspective of the study, substantiated by the sociopolitical approach taken by legal institutions. Next, it addresses the definition and the relevance of the topic based on bibliographic search regarding elite recruitment methods, as well as the process of diversification of legal departments in Brazil, emphasizing studies on the practices and representations evoked by the admittance of women in judiciary careers. Then, a compilation of the collected data — in other words, field observations and interviews provided by the appeals court judges — is presented, in order to identify possible patterns and pathways that are common to the women who took office as appeals court judges. Thus, the goal is to advance in understanding the recruitment of this portion of the legal elite and its relation to the process of diversification of legal departments in the context of social and political dynamics, represented by the admittance of women in the highest level of judiciary careers in the state of Rio Grande do Sul.
