Expressões insurgentes e conflito urbano : reflexões sobre o graffiti na área central de Porto Alegre

Abstract

O presente trabalho discorre sobre o graffiti (produzido por grupos distintos com motivações diferentes), suas diversas formas de manifestação no espaço urbano e o conflito gerado entre esses grupos e os poderes estabelecidos, a partir da ocorrência dessa expressão insurgente em Porto Alegre/RS. Nesse sentido, analisou-se o posicionamento do Poder Judiciário e do Poder Executivo, a partir de materiais e documentos oriundos da imprensa, do Ministério Público do RS, do 3º Juizado Especial Criminal de Porto Alegre (3º JECRIM), do Tribunal de Justiça do RS (TJRS), e das legislações federal e municipal pertinentes, considerando entendimentos advindos das tendências contemporâneas do Direito: Criminologia Cultural, Labelling Approach e Meio Ambiente Cultural (Direito Ambiental). A partir do exame desses materiais, várias questões sobre os modos de ocupação e de percepção do espaço urbano são abordadas. Também foram trazidos para discussão dois casos polêmicos envolvendo a fixação de graffiti na fachada de edificações em Porto Alegre: a sede da Fundação Ecarta (2012) e o muro do Goethe-Institut (2018). A investigação do fenômeno do graffiti sob a ótica de diferentes atores urbanos, e a tensão por ele causada analisada sob perspectivas diversas, permitiu sua verificação sob pontos de vista antagônicos, que estão problematizados neste trabalho. Esse conjunto de circunstâncias gera uma multiplicidade de compreensões e percepções sobre o urbanismo vigente e sobre os diferentes modos urbanos de vida, o que torna possível a observação da cidade e do graffiti como fenômenos urbanos complexos, que permitem diversas reflexões, questionando alguns estatutos e consensos estabelecidos.

The present work discusses graffiti (produced by distinct groups with different motivations), its different manifestation forms in the urban space and the conflict generated between these groups and the established powers, from the occurrence of this insurgent expression in Porto Alegre / RS. In this sense, the positioning of the Judiciary and Executive Power was analyzed, based on materials and documents from the press, the Public Ministry of the state (of Rio Grande do Sul, Brasil) , the 3rd Special Criminal Court of Porto Alegre city, Brasil (3rd JECRIM), the Court of Justice of the RS (TJRS), and the relevant federal and municipal laws, considering understandings arising from contemporary trends in Law: Cultural Criminology, Labeling Approach and Cultural Environment (Environmental Law). From the examination of these materials, several questions about the modes of occupation and perception of urban space are addressed. Two controversial cases involving the fixing of graffiti on the facade of buildings in Porto Alegre were also brought up for discussion: the headquarters of the Ecarta Foundation (2012) and the wall of the Goethe-Institut (2018). The investigation of the graffiti phenomenon from the perspective of different urban actors and the tension caused by it, analyzed from different perspectives, allowed its verification under antagonistic points of view, which are problematized in this work. This set of circumstances generates a multiplicity of understandings and perceptions about the current urbanism and about the different urban ways of life, which makes it possible to observe the city and graffiti as complex urban phenomena, which allow different reflections, questioning some statutes and settled down consensus.
