O tratamento diferenciado concedido às micro e pequenas empresas e aos microempreendedores individuais no município de São Lourenço do Sul/RS

Abstract

A Lei Complementar n.º 123, de 14 de dezembro de 2006 – LC 123/06, é o instrumento jurídico mais importante na diferenciação e favorecimento das microempresas, empresas de pequeno porte e dos microempreendedores individuais, servindo como norte para as políticas públicas direcionadas a esta parte da sociedade. Ela surgiu para regulamentar o tratamento diferenciado concedido àqueles tipos empresariais, previsto como princípio no artigo 170, inciso IX e artigo 179 da Constituição Federal de 1988. Em atenção aos benefícios previstos na LC 123/06, bem como forte no princípio da autonomia entre os entes da federação, cabe a cada município editar as suas regras a fim de dar efetividade às políticas públicas no âmbito municipal. Assim, através de uma pesquisa descritiva, de caráter qualitativo, com técnicas de pesquisa documental e bibliográfica, especialmente ancorada nos instrumentos jurídicos editados pelo município, esse estudo tem como objetivos identificar quais foram as medidas adotadas pelo Município de São Lourenço do Sul/RS, bem como quais poderiam ser adotadas a fim de concretizar o tratamento diferenciado concedido pela LC 123/06. Verifica-se que algumas medidas já foram adotadas pelo Município, através da Lei n.º 3.097, de 2009, e do Decreto n.º 4.783, de 2018, porém importantes políticas ainda devem ser criadas com a pretensão de tornar efetivo os benefícios trazidos pela LC 123/06 às micro e pequenas empresas e aos microempreendedores individuais no âmbito municipal, como a entrada única e via internet das licenças municipais e a isenção de taxas e emolumentos para os microempreendedores individuais.

The Complementary Law n.º 123, from December 14th of 2006 – LC 123/06, it is the most important legal instrument in the differentiation and favoring of micro enterprises, small enterprises and individual microentrepreneurs, serving as guide to the public politics directed to this part of society. The law came to regulate the differential treatment granted to those business types, foreseen as principle in the article 170, subsection IX and article 179 of the Brazilian Federal Constitution from 1988. In view of the benefits provided in LC 123/06, as well as strong in the principle of autonomy between the entities of the federation, it is up to each city to edit its rules in order to give effectiveness to the public policies in the city scope. So, through a descriptive research, of qualitative character, with documental and bibliographic research techniques, especially anchored in the legal instruments published by the city, this study has as goals to identify which were the measures adopted by the city of São Lourenço do Sul / RS, as well which of the measures could be adopted in order to achieve the differential treatment granted by LC 123/06. It is verified that some measures have already been adopted by the city, through law n.º 3.097, of 2009, and decree n.º 4.783, of 2018, but important measures still have to be created with the intention of making effective the benefits brought by LC 123/06 to micro and small enterprises and to individual microentrepreneurs at the city level, such as the single and online entry of municipal licenses and the exemption of fees and emoluments for individual microentrepreneurs.
