Legislação urbanística e materialidade : estudo da relação entre densidade e mobilidade em Passo Fundo/RS

Abstract

O presente trabalho investiga a articulação entre densidade urbana – construtiva e populacional – e mobilidade urbana – a partir da infraestrutura – no âmbito do planejamento e da gestão. Para tal, toma como estudo de caso a área urbana do município de Passo Fundo/RS, com foco no Plano Diretor de Desenvolvimento Integrado (PDDI/2006) e o reflexo destas proposições na materialidade através de casos estudados. A relação entre estes dois elementos parte da ideia da articulação retroalimentada ocasionada pelos fixos e fluxos (SANTOS, 2009a, 2014) enquanto estruturadores do espaço. O planejamento buscaria ordenar estes elementos de maneira eficaz, baseado nos preceitos da CF/1988 e demais leis infraconstitucionais, de modo a promover a função social da propriedade e da cidade. Destacam-se, portanto, o papel do zoneamento e dos parâmetros construtivos como regradores do espaço construído. Tendo em vista o potencial de valorização do solo urbano gerado não apenas pelas infraestruturas e serviços (o que caracterizaria a localização), mas pelo potencial construtivo determinado pelo regramento urbanístico, este, em um processo de flexibilização tende a promover a ampliação do potencial construtivo e de adensamento e/ou liberar localizações e atividades, o que vem sendo atualmente, naturalizado. A pesquisa adota como background explicativo três conceitos teóricos: a Pós-Modernidade, como atual fase do Capitalismo (HARVEY, 2014); o Neoliberalismo, ao limitar a atuação do Estado enquanto regrador, passando a ser um facilitador da atuação do Mercado e o Neoconstitucionalismo, ao instituir a flexibilização da norma jurídica frente à interpretação de princípios. Em Passo Fundo/RS foram identificadas alterações no plano diretor municipal, sobre o uso e a ocupação do solo, especificamente aqui tratado como regramento das densidades. A pesquisa, primeiramente, busca um estudo comparativo das diretrizes definidas originalmente pelo plano diretor (PDDI, 2006) e as alterações até 2018, objetivando caracterizar e identificar a localização das áreas onde houve a flexibilização do regime urbanístico. Referente à mobilidade, a pesquisa aborda a estrutura de circulação, ou seja, as vias. Desse modo, identificam-se as diretrizes e as estratégias definidas pelo planejamento, bem como verifica-se quais intervenções propostas foram executadas. A etapa seguinte busca análise conjunta (densidade x mobilidade) com o objetivo de verificar a articulação entre ambos através dos atos do planejamento e da gestão. A Sintaxe Espacial foi utilizada para analisar a localização das alterações frente a acessibilidade resultante da configuração da malha viária. A partir da interpretação conjunta destas análises, e com o auxílio da Teoria da Teia Urbana, foi possível apontar a fragmentação em diversas soluções adotadas pelo planejamento, a gestão e seus reflexos na cidade.

This research investigates the articulation between urban density - constructive and population - and urban mobility - from infrastructure - in the planning and management. To this end, the study is developed through a case study of the urban area of Passo Fundo/RS, focusing on the Plano Diretor de Desenvolvimento Integrado (PDDI/2006) and the reflection of these propositions on materiality through case studies. The relationship between these two elements starts from the idea of the feedback loop caused by the fixed and flows (SANTOS, 2009a, 2014) as space structurers. Planning would seek to order these elements effectively, based on the precepts of CF / 1988 and other laws, promoting the social function of property and the city. Therefore, we highlight the role of zoning and constructive parameters as rulers of the built space. Considering the potential of urban land valorization generated not only by the infrastructures and services (which would characterize the location), but also by the constructive potential determined by the urbanistic rule, this one, in a flexibilization process tends to promote the expansion of the constructive potential and densification and / or releasing locations and activities, which is currently being naturalized. The research adopts as explanatory background three theoretical concepts: Postmodernity, as the current phase of Capitalism (HARVEY, 2014); Neoliberalism, by limiting the State's role as a ruler, becomes a facilitator of the Market's performance and Neoconstitutionalism, by instituting the flexibility of the legal norm in the face of the interpretation of principles. In Passo Fundo/RS, changes were identified in the municipal master plan on land use and occupation, specifically dealt with here as density regulation. The research, firstly, seeks a comparative study of the guidelines originally defined by the master plan (PDDI, 2006) and the alterations until 2018, aiming to characterize and identify the location of the areas where the urbanization regime became more flexible. Regarding mobility, the research addresses the structure of circulation, ie the roads. In this way, the guidelines and strategies defined by the planning are identified, as well as which proposed interventions were implemented. The next step seeks joint analysis (density x mobility) in order to verify the articulation between both through the planning and management acts. Spatial Syntax was used to analyze the location of changes in relation to accessibility resulting from the road network configuration. From the joint interpretation of these analyzes, and with the help of the Urban Web Theory, it was possible to identify the fragmentation in several solutions adopted by planning, management and their reflexes in the city.
