Precaução e prevenção : princípios jurídicos para a tutela de relações jurídicas distintas ou apenas institutos idênticos com denominação diversa

Abstract

O trabalho tem como objetivo investigar se os princípios da prevenção e precaução são realidades jurídicas distintas em direito ambiental. Constitui-se de uma pesquisa qualitativa acerca da doutrina e jurisprudência sobre o tema, com ênfase em material pátrio. Relata a importância dos princípios no sistema normativo nacional, já que deles se extraem regras cujo cumprimento pode ser requerido pelos operadores do direito ao Poder Judiciário. Analisa as definições e os componentes conceituais dos princípios da prevenção e precaução. Busca similitudes e diferenças entre eles, com o escopo de avaliar se sua compreensão como realidade diversa repercute na proteção do meio ambiente e se essa distinção deve ser entendida dentro de uma lógica de oposição ou de complementaridade. Conclui pela sua distinção ressaltando que essa compreensão em apartado traz consequências significativas para a proteção do meio ambiente.

The study aims to investigate the precautionary system and if it could be applied to different legal realities in environmental matters. It consists of a qualitative research on the doctrine and jurisprudence on the subject, with an emphasis on home material. Search similarities and differences between them, with the aim of assessing whether your understanding how different reality affects the protection of the environment and this distinction must be understood within a logical opposition or complementarity. It concludes by emphasizing that its distinct understanding has significant consequences for the protection of the environment.
