O objetivo do presente trabalho é analisar o direito fundamental ao contraditório na perspectiva do processo civil cooperativo, bem como o direito de influência que as partes exercem na decisão judicial. Por meio da análise da posição ocupada pelos sujeitos processuais, seus papéis e deveres colaborativos, pretende-se demonstrar que o contraditório forte decorre do dever de diálogo entre partes e juiz, tendente à obtenção de uma tutela jurisdicional efetiva, por meio de um processo justo. A partir de uma abordagem doutrinária, como também legislativa, especialmente dos dispositivos do novo Código de Processo Civil, almeja-se demonstrar que o modelo processual consentâneo com o Estado Constitucional é o cooperativo, no qual se impõe ao magistrado que leve em conta as manifestações e provas produzidas pelas partes, oportunizando que estas sejam previamente ouvidas antes da decisão, vedando-se a decisão surpresa que possa prejudicá-las. ...
