Brasil, o direito do mar e a convenção das nações unidas: Amazônia azul

Abstract

O Direito do Mar encontra-se de forma concreta, inserido no contexto social e positivado em convenções e tratados internacionais. A partir da legislação atual, principalmente a Convenção das Nações Unidas sobre o Direito do Mar de 1982, pretende-se analisar o caso da expansão da plataforma continental do Brasil, por meio do diagnóstico crítico-interpretativo da Amazônia Azul. Será traçado um panorama jurídico sobre o tema, visando aspectos teóricos e legais. Serão analisados elementos históricos do Direito do Mar e a codificação dos oceanos, por meio do desenvolvimento do costume internacional na utilização dos espaços marítimos. Para facilitar o processo de análise do tema proposto, este trabalho foi dividido em dois capítulos. A metodologia utilizada foi a pesquisa bibliográfica em doutrina e legislação.

The Law of the Sea is concretely inserted in the social order, regulated in conventions and international treaties. From the current legislation, especially the United Nations Convention on the Law of the Sea of 1982, it is intended to analyze the case of the expansion of the Brazilian continental shelf, by a critical-interpretative analysis of the Blue Amazon. A juridical panorama will be drawn about the theme, aiming theoretical and legal aspects. It will be analyzed the historical elements of the Law of the Sea, the codification of the oceans through the development of international custom in critique of the subject, this study was divided into two chapters. The methodology used was the bibliographical research in doctrine and legislation.
