Historicidade do direito do consumidor : personalidades e fatos que contribuíram à existência da proteção contemporânea

Abstract

O presente trabalho visa trazer uma maior abrangência sobre a cronologia da tutela consumerista, visto que, aspectos da história do direito do consumidor são tratados de forma minuciosa com o objetivo de proporcionar um maior conhecimento das leis, ocorrências e indivíduos que contribuíram significativamente para que hoje houvesse uma harmonização no mercado econômico. Trata-se de informações sobre personalidades, fatos e normas que existiram em tempos remotos e que gradualmente foram adquirindo proporções mais abrangentes, até que fossem inseridas no contexto das legislações atuais. A pesquisa busca enaltecer o trabalho até aqui realizado e que contribuiu para que os cidadãos de hoje fossem respeitados em sua dignidade humana, tendo em vista que, atualmente, esses direitos são tratados como fundamentais. Para que esse estudo fosse possível, foram pesquisadas importantes obras dos principais doutrinadores sobre o assunto no Brasil e no mundo. Foram levantadas considerações referentes ao perfil do consumidor sob a ótica economicista e também as influências mundiais a respeito da matéria, sejam elas: o fenômeno da massificação póssegunda guerra mundial, o início da discussão delimitada após o discurso do presidente americano John Kennedy e as iniciativas populares na Comunidade Europeia. Também o surgimento de leis protecionistas na América Latina e como é enfrentado o assunto no que toca ao Tratado do MERCOSUL. No Brasil, verificam-se possíveis fatores que determinaram a conduta social utilizada por aqueles que desejavam obter vantagens nas tratativas comerciais e constata-se desde as primeiras normativas até as contemporâneas. Em última análise, defendem-se os benefícios que advêm da união do Código de Defesa do Consumidor com o Código Civil. Em suma, que a responsabilidade da existência de uma legislação protetiva não pertence somente àqueles que, no passado, agregaram seu empenho vigorosamente, mas também a todos que na atualidade usufruem de suas garantias.

The present work aims to bring about a broader chronology protection consumerist, since aspects of the history of consumer law are treated in detail in order to provide a greater knowledge of the laws, events and individuals who have contributed significantly to today there was a harmonization in the economic market. There are information’s about personalities, facts and rules that existed in ancient times that were gradually gaining wider proportions, until they were placed in the context of current legislation. The research seeks to praise the work done so far and that contributed to today's citizens are respected in their human dignity, considering that, in the current context, these rights are treated as fundamental rights. For this study become possible, were surveyed important works of the leading scholars on the subject in Brazil and worldwide. Considerations were raised concerning the profile of the consumer under the economistic perspective and also the world influences on the matter, whether they are: the phenomenon of mass post-World War II, the beginning of the discussion after the speech bounded U.S. President John Kennedy and popular initiatives in the European Community. Also the emergence of protectionist laws in Latin America and how the issue is faced as regards to the Treaty of MERCOSUR. In Brazil, there are possible factors that determine social behavior used by those wishing to gain an advantage in trade negotiations and it appears from the earliest to the contemporary normative. In final analysis, defend themselves by the benefits that arising out of the union Code of Consumer Protection with the Civil Code. In sum, the responsibility of the existence of protective legislation does not belong only to those who in the past have added their efforts vigorously, but also to all who currently enjoy their warranties.
