O presente trabalho tem como enfoque o artigo 482 da Consolidação das Leis do Trabalho no que se refere à despedida por justa causa do empregado que sofre de embriaguez habitual ou em serviço. Sabe-se que o álcool é o principal contribuinte para a embriaguez, eis que ingerido de imediato já provoca consideráveis alterações visíveis. O alcoolismo, o qual deriva de uma dependência química, é um dos problemas sociais mais assustadores e difundidos no mundo atual, não só pelo fato de atingir as classes sociais, como também não ter cura; além de trazer problemas para si mesmo, seja no trabalho ou na vida social, traz complicações familiares, atingindo os parentes mais próximos que se tornam co-dependentes na luta contra a doença. Entende-se que o alcoólatra deve ser considerado uma pessoa doente que necessita de tratamento e apoio. O alcoolismo é considerado, pela Organização Mundial da Saúde – OMS, uma doença progressiva e incurável, devendo o doente ser encaminhado para tratamento. A rescisão contratual do empregado, portador da doença do alcoolismo, por justa causa, conforme disposto no artigo 482, alínea f da CLT, torna-se injusta, pois não se enquadraria em uma falha, defeito ou infração, e sim em uma falta de controle sobre ingestão do álcool. ...

This work is to focus Article 482 of the Consolidation of Labor Laws in regard to dismissal for cause employee suffering from habitual intoxication during working hours. It is known that alcohol is the main contributor to drunkenness, behold ingested immediately already causes significant changes visible. Alcoholism, which is derived from a substance abuse is one of the most daunting social problems and widespread in the world today, not only because of achieving social classes, but also no cure; besides bringing problems for yourself, whether at work or in social life, brings family complications, reaching the closest relatives who become co-dependent in the fight against the disease. It is understood that the alcoholic should be considered a sick person who needs treatment and support. Alcoholism is considered by the World Health Organization - WHO, a progressive and incurable disease and the patient should be referred for treatment. The termination of the employee, bearer of the disease of alcoholism, for cause, as provided in Article 482, paragraph f of the Labor Code, it is unfair because it would not fit in a failure, defect or violation, but rather in a lack of control of intake of alcohol. ...
