A aplicação da convenção internacional de Haia sobre os aspectos civis do sequestro internacional de crianças à luz do princípio do melhor interesse da criança

Abstract

A Convenção de Haia sobre os Aspectos Civis do Sequestro Internacional de Crianças visa principalmente promover a devolução segura da criança ilicitamente retirada de seu país de residência habitual por um dos seus pais ou parente próximo, o chamado sequestrador. O aludido tratado multilateral se aplica entre os Estados contratantes e busca garantir os direitos relacionados à convivência familiar. Dos dispositivos da Convenção se extrai que a retirada ilícita da criança de seu país de residência habitual é taxativamente negativa, porquanto a criança afastada de seu ambiente familiar, amigos e família, certamente sofrerá uma ruptura se levada para terra estrangeira, onde pode não possuir vínculo afetivo algum a não ser com o próprio sequestrador1. Contudo, ainda que objetive a Convenção proteger a criança internacionalmente dos efeitos maléficos do deslocamento ou retenção ilegal, verifica-se a dificuldade de aplicação das rigorosas exceções positivadas nos artigos 13, b e 20 nos casos em que o retorno do infante representar uma violação aos seus direitos fundamentais. Assim, aborda o presente estudo, de um lado, o dever de cooperação material entre os Estados signatários no que tange à promoção do imediato restabelecimento da criança ao status quo, e de outro, o atendimento ao melhor interesse da criança e seus desdobramentos.

The Hague Convention on the Civil Aspects of International Child Abduction aims mainly to promote the safe return of the child that was illegally withdrawn from the country of its habitual residence by one of its parents or near of kin, the so called abductor. The alluded multilateral treaty applies between the contracting States and seeks to guarantee the rights related to family life. From the articles of the convention it’s extracted that illicit remotion of the child from its habitual residence country is exhaustively harmful, because the distance of friendly and familiar environment certainly causes a routine rupture, where the infant may not have the opportunity of building emotional ties with anyone but the abductor. However, even though the main goal of the convention is to offer the child international protection against the evil effects of displacement process or illegal retention, there is a difficulty on the application of the strict exceptions of the convention cited at articles 13b and 20, in the cases where the return of the infant represents a violation of fundamental rights. Thus, this study addresses by one side the duty of cooperation between the signatory states on the immediate reestablishment of the status quo of the child, and, on the other side, on the treatment of the best interest of the child and its consequences.
