Implicações dos acordos SPS e TBT na segurança alimentar a partir das decisões da OMC

Abstract

O presente estudo tem como tema as implicações da aplicabilidade do Acordo de Medidas Sanitárias e Fitossanitárias e do Acordo de Barreiras Técnicas na segurança alimentar, a partir das decisões da OMC. Neste sentido, os objetivos desse trabalho são analisar os marcos jurídicos que referenciam às soluções de controvérsias da OMC, averiguar os casos referentes à proteção da saúde humana envolvendo o Brasil na OMC, investigar o parecer do Brasil, verificar os critérios que contribuem ou impedem a proteção à saúde humana, ou seja, à segurança alimentar. Para tanto, tece-se um relato e reflexão acerca do leading case hormones. Para a consecução dos objetivos propostos, foi realizado levantamento bibliográfico. A partir disso, pode-se constatar que as medidas adotadas pelos países Membros da OMC são averiguadas a partir de uma matriz de análise de risco, baseada em princípios científicos, para evitar que essas sejam utilizadas para satisfazer necessidades políticas e econômicas. Ocorre que em que pese a objetividade da avaliação seja desejável, há diversos pontos impugnados na controvérsia questionando o procedimento e critérios para avaliar o risco, tais como a forma como são escolhidos os especialistas, a suficiência dos testemunhos científicos e as diversas percepções e escolhas do nível adequado de proteção adotado pelos países. Portanto, depreendeu-se necessária a ponderação a respeito da aplicação do princípio da precaução.

The theme of the present study is the implications of the applicability of the Agreement on the Application of Sanitary and Phytosanitary Measures (SPS) and the Agreement on Technical Barriers to Trade (TBT) on food safety based on the World Trade Organization (WTO) decisions. In this sense, the objectives of this work are to analyze the legal frameworks that reference the WTO controversy solutions, to inquire the cases concerning the human health protection involving Brazil on the WTO, to examine the brazilian report, and to verify the criteria that contribute to or impede the human health protection, that is, food safety. To this end, an account and a reflection about the leading case hormones is are made. In order to fulfill the proposed objectives, a research on the literature was conduced. Given that, it was evidenced that measures adopted by the WTO Members are verified from a risk analysis matrix, based on scientific principles, to avoid them to be used to satisfy political and economic necessities. Even though the objectivity of the evaluation is desirable, there are several points challenged in the controversy questioning the procedure and the criteria used to evaluate the risk, such as how the specialists were chosen, the sufficiency of the scientific testimony and the diverse perceptions e choices about the adequate level of protection adopted by the countries involved in the controversy. Therefore, it is necessary the reflection concerning the application of the precautionary principle.
