Crime organizado ambiental nas áreas de preservação permanente da Amazônia brasileira (2000-2017)

Abstract

A fim de explorar o agravamento da crise climática e o papel da Floresta Amazônica nesse contexto, este trabalho busca compreender a ocorrência de crimes ambientais nas Áreas de Preservação Permanente da Amazônia Legal, entre 2000 e 2017. Tal análise permitiu identificar a diversificação das ações do crime organizado para a inclusão do crime ambiental, pelo alto lucro e pela baixa punitividade que essa atividade representa. Considerando que o crime organizado ascende em locais com baixa presença estatal, a Floresta Amazônia tem, ao mesmo tempo, os facilitadores geográficos para a ocorrência dessas atividades ilícitas e os recursos ambientais que permitem cada vez mais lucros. Dessa forma, o Brasil e os demais países da América do Sul que possuem território de floresta amazônica presenciam a ação de grupos criminosos com presença internacional, que ameaçam o monopólio da força domesticamente e a segurança internacional. Diante deste cenário, o enfrentamento tradicional aos crimes ambientais precisa ser revisto, considerando a evolução desses crimes, atualmente suportados por redes criminosas organizadas, incluídas na sociedade brasileira, que possuem capacidade de coerção, contam com a participação de agentes corruptos e indivíduos com conhecimento técnico. Portanto, essas redes são capazes de contornar ações de enfrentamento que o Estado brasileiro empreende e reorganizar-se para manter suas ações ilícitas.

In order to explore the worsening of the climate crisis and the role of the Amazon Forest in this context, this work seeks to understand the occurrence of environmental crimes in the Permanent Preservation Areas of the Legal Amazon, between 2000 and 2017. This analysis allowed identifying the diversification of the actions of organized crime to the inclusion of environmental crime, due to the high profit and low punitiveness that this activity represents. Considering that organized crime rises in places with low state presence, the Amazon Forest has, at the same time, geographic facilitators for the occurrence of these illicit activities and environmental resources that allow increasingly more profits. Therefore, Brazil and the rest of South American countries that have Amazon forest territory witness the actions of criminal groups with an international presence, which threaten the monopoly of force domestically and international security. Given this scenario, the traditional approach to environmental crimes needs to be reviewed, considering the evolution of these crimes, currently supported by organized criminal networks, included in Brazilian society, which have the capacity for coercion, rely on the participation of corrupt agents and individuals with technical knowledge. In this way, these networks are capable of circumventing confrontational actions that the Brazilian State undertakes and reorganizing themselves to maintain their illicit actions.
