O presente trabalho busca analisar a Constituição Política do Estado Plurinacional da Bolívia de 2009, promulgada durante o governo de Evo Morales, a partir da literatura que relaciona populismo e constitucionalismo. Nesta literatura, se destaca uma teoria: o constitucionalismo populista. Essa tradição teve início nos Estados Unidos, em finais do século XX, sendo ela muito próxima ao constitucionalismo popular – proximidade que faz alguns autores apontarem que sequer existe uma diferença entre as duas teorias. Posteriormente, o constitucionalismo populista difundiu-se para a análise de constituições em outras partes do globo, sobretudo nos últimos anos, quando essa teoria passou a ser aplicada às novas constituições da América Latina e do Leste Europeu. A Constituição Boliviana é uma delas, tanto pelo seu caráter crítico ao constitucionalismo liberal quanto pelo fato de Evo Morales ser considerado um líder populista. Essa constituição, porém, apresenta algumas especificidades que requerem que ela seja encarada com maior atenção, algo que até então não foi realizado por estes autores. This present work aims to analyze the Political Constitution of the Plurinational State of Bolivia of 2009, established during Evo Morales' government, through the literature that relates populism and constitutionalism. This present work aims to analyze the Political Constitution of the Plurinational State of Bolivia of 2009, established during Evo Morales' government, through the literature that relates populism and constitutionalism. In this literature, one theory stands out: populist constitutionalism. This tradition had begun in the United States, in the late 20th century, in a close relation with popular constitutionalism -- which makes some authors point to the fact that there is no difference between the two theories. Later, populist constitutionalism started to spread across the globe, mostly in the past few years, when this theory began to be applied to the new constitutions of Latin America and Eastern Europe. The Bolivian constitution is one of them, both for its critical approach to liberal constitutionalism and for the fact that Morales is often considered a populist leader. This constitution, however, has some unique characteristics that require it to be analyzed more carefully, which has not been done yet by these authors.
