Relações entre organizações da sociedade civil ligadas a proteção animal com o poder público no município de Porto Alegre - RS

Abstract

Este relatório traz como tema os modos de atuação das organizações públicas e, das organizações da sociedade civil, ligadas a proteção animal no município de Porto Alegre – RS, bem como a maneira pela qual relacionam-se contratualmente com os governos em nível municipal, estadual e federal. A pesquisa foi desenvolvida através de critérios do método indutivo, com pesquisa teórica praticada no capítulo um e, pesquisa explicativa realizadas nos capítulos dois e três. Sabe-se que a justificativa à existência das instituições ligadas a proteção animal, no âmbito da sociedade civil, é a incapacidade e/ou desinteresse dos governos na agenda animal. Embora tais instituições venham a corrigir e/ou atenuar a ausência do Estado nessa agenda, a relação com os governos não necessariamente tem sido vantajosa. Nesse sentido, indagou-se quais os impactos operacionais e contratuais que o poder público causa às organizações sociais ligadas a proteção animal no município de Porto Alegre – RS? O objetivo geral foi o de analisar as principais organizações da sociedade civil atuantes na proteção animal no município de Porto Alegre - RS, averiguando seu modo de gestão e, as ações realizadas na comunidade, bem como apurar se tais organizações possuem parcerias com o governo. Entre os específicos: explicar o entendimento acerca de proteção animal e, as justificativas fundamentais para a necessidade de legislação e políticas voltadas para essa área; identificar as leis do Estado brasileiro que legitimam a existência das organizações sociais e, organizações públicas, no âmbito da sociedade civil; verificar quais são as organizações sociais e, organizações públicas, ligadas a proteção animal no município de Porto Alegre – RS; apresentar as leis que normatizam as relações contratuais entre as organizações sociais e, organizações públicas no Brasil; examinar quais organizações possuem parcerias com o governo e, em havendo, avaliar as supostas vantagens e desvantagens dessa parceria; averiguar as ações empreendidas pelas organizações ligadas a proteção animal em Porto Alegre – RS.

This paper has as a theme the ways of action of public organizations and civil society organizations linked to animal protection in the city of Porto Alegre - RS, as well as the way in which they are contractually related to governments at municipal, state and federal levels. The research was developed through inductive method criteria, with theoretical research applied in chapter one and, explanatory research carried out in chapters two and three. It is known that the justification for the existence of institutions linked to animal protection within the civil society is an incapacity and / or lack of interest from governments in the animal agenda. Considering that these organizations come to rectify and / or mitigate the State’s absence on this agenda, a relationship with governments has not necessarily been advantageous. In this sense, it was asked which operational and contractual impacts the public power causes to the social organizations linked to the animal protection in the city of Porto Alegre - RS? The general objective was to analyze the main civil society organizations involved with animal protection in the city of Porto Alegre - RS, investigating their way of management and actions carried out in the community, as well as ascertain if such organizations have partnerships with the government. Among the specifics: to explain the understanding about animal protection and the fundamental justifications for the need of legislation and policies in this area; to identify the Brazilian State’s laws which legitimize the existence of social organizations and public organizations within civil society; verify which are the social organizations and public organizations linked to animal protection in the city of Porto Alegre - RS; to present laws which normalize the contractual relations between social organizations and public organizations in Brazil; to examine which organizations have partnerships with the government and, if so, to evaluate the supposed advantages and disadvantages of this partnership; and to investigate the actions taken by the organizations involved with animal protection in Porto Alegre - RS.
