O novo FUNDOPEM/RS : uma análise das mudanças introduzidas e dos projetos enquadrados no novo formato

Abstract

O Programa Fundo Operação Empresa – FUNDOPEM/RS é a principal ferramenta de atração de investimentos do Governo do Estado do Rio Grande do Sul. Este incentivo consiste em um programa que permite àqueles empresários que realizem investimento e gerem empregos postergar o pagamento do Imposto sobre Circulação de Mercadorias e Serviços – ICMS, de forma a financiar os custos fixos do investimento. O beneficio é concedido sobre o ICMS incremental, ou seja, sobre aquela parcela do ICMS que não existiria caso o investimento não fosse realizado. O Programa de Harmonização do Desenvolvimento Industrial do Rio Grande do Sul – INTEGRAR/RS é um abatimento que incide sobre parte do valor a ser amortizado do FUNDOPEM/RS, fazendo com que uma parcela do incentivo concedido seja não reembolsável. O objetivo deste trabalho é analisar (i) as mudanças introduzidas no FUNDOPEM/RS e no INTEGRAR/RS em 2011, e (ii) o enquadramento dos projetos no novo modelo. A hipótese principal é de que as modificações introduzidas foram significativas e consoantes com uma estratégia mais ampla de desenvolvimento. No primeiro capítulo, buscaremos discutir o papel do Estado na promoção do desenvolvimento e o uso de incentivos fiscais para atingir este objetivo. O segundo capítulo apresentará uma breve revisão da evolução histórica do FUNDOPEM/RS, ressaltando as principais modificações ocorridas em cada uma das suas fases. O terceiro capítulo apresentará a atual Política Industrial do Estado do Rio Grande do Sul e as modificações implementadas recentemente no FUNDOPEM/RS. Por fim, o quarto capítulo analisará os projetos enquadrados no Novo FUNDOPEM/RS.

The Company Operation Fund Program – FUNDOPEM/RS (in Portuguese, Fundo Operação Empresa) is the main tool used by the State Government of Rio Grande do Sul to attract investments. This incentive program allows entrepreneurs who make investments and generate jobs to postpone the payment of the Tax on Circulation of Goods and Services – ICMS (in Portuguese, Imposto sobre Circulação de Mercadorias e Serviços), in order to finance the fixed investment costs. The benefit is granted on the incremental ICMS, i.e. the ICMS installment which wouldn't exist if there were no investments. The Industrial Development Harmonization Program of Rio Grande do Sul – INTEGRAR/RS (in Portuguese, Programa de Harmonização do Desenvolvimento Industrial do Rio Grande do Sul) is a tax relief related to the amount that shall be amortized from the FUNDOPEM/RS, making a part of the granted incentive not refundable. The aim of this paper is to analyze (i) the changes introduced to the FUNDOPEM/RS and to the INTEGRAR/RS in 2011, and (ii) the framework for projects in the new model. The main hypothesis is that the changes introduced have been significant and in line with a broader strategy of development. In the first chapter, we discuss the role of the State in promoting development and the use of tax incentives to reach this goal. The second chapter presents a brief review of the FUNDOPEM/RS historical evolution, highlighting the main changes in each of its phases. The third chapter presents the current Industrial Policy of Rio Grande do Sul, and the recently implemented changes to the FUNDOPEM/RS. Finally, the fourth chapter analyses the projects framed in the New FUNDOPEM/RS.
