Marcas e indicações geográficas (IG) registradas, quando semelhantes ou idênticas podem ser confundidas pelo consumidor. Uma das alternativas para evitar isso tem sido a aplicação do princípio da especialidade, por meio do qual permite-se a convivência de signos semelhantes apenas quando se referirem a produtos ou serviços diferentes. Neste trabalho, por meio de uma pesquisa de caráter teórico, utilizando-se do método bibliográfico e documental, foi investigada a viabilidade de aplicação desse princípio para resolver o conflito entre IG e marca. Como resultado, verificou-se não ser possível a utilização do mesmo, em virtude da marca e da IG possuírem naturezas jurídicas distintas, e, em alguns casos, a aplicação mostrar-se insuficiente para resolver o problema. ...
