A Proteção de dados pessoais na promoção do trabalho digital decente : a mitigação da assimetria informacional na gestão algorítmica

Abstract

O artigo trata do tema da proteção de dados pessoais, tendo por delimitação as relações de trabalho mediadas por plataformas digitais. A pesquisa se justifica em razão da atualidade e dos desafios e vulnerabilidades do contexto do trabalho de plataformas digitais, especialmente no que tange à proteção dos dados pessoais destes trabalhadores. O problema de pesquisa do artigo é o seguinte: as diretrizes e obrigações estabelecidas na Lei Geral de Proteção de Dados (LGPD) podem auxiliar trabalhadores de plataformas digitais na concretização do trabalho digital decente? Como método científico de abordagem do assunto, é utilizado o método hipotético-dedutivo.

The article deals with the topic of personal data protection, delimiting work relationships mediated by digital platforms. The article’s research problem is whether the guidelines and obligations set forth in the General Law on Data Protection (LGPD) can assist digital platform workers in achieving decent digital work? The results of the research are affirmative, highlighting as final conclusions the need for special attention in examining the LGPD’s compliance with free consent and the principles of transparency, necessity and purpose. The hypotheticaldeductive method is used as the scientific method of approach to the subject.
