Análise tipológica dos registros de imóveis de Porto Alegre: de 1850 ao advento do código civil em 1917

Abstract

A presente pesquisa denota a importância da Arquivologia e da Diplomática no contexto social em seus métodos científicos, demonstrando através da análise do Registro de Imóveis o crescimento imobiliário e a evolução da cidade. A análise da legislação de cada período pesquisado juntamente com os estudos de análise diplomática e análise tipológica forneceram cabedal teórico suficiente para responder o problema proposto, expondo a questão das mudanças nas formas de registrar um imóvel e seu reflexo nos registros. A pesquisa objetiva compreender como eram realizados os registros de imóveis em Porto Alegre de 1850 ao advento do código civil brasileiro. Para isso, propõe-se a analisar as características intrínsecas e extrínsecas do registro imobiliário em Porto Alegre, ocasionando o entendimento direcionado à questão da construção semântica do registro. Para esse fim, foram revisados os conceitos sobre Arquivologia, Diplomática e Tipologia Documental. As análises foram baseadas a partir do suporte dos conceitos da Diplomática e das formas de apresentação dos registros juntamente com os caracteres intrínsecos e extrínsecos a contrabalancear com a teoria sobre Tipologia Documental. Seguiu-se a análise e identificação de possíveis mudanças nos elementos externos e internos dos registros a contar dos períodos em que houveram mudanças na legislação. A revisão de literatura aborda aspectos relacionados ao contexto histórico do Registro de Imóveis e da propriedade no Brasil, adentrando na análise das legislações que amparavam o direito à propriedade em diferentes épocas. Diante dessa realidade, identificaram-se mudanças significativas nos registros, demonstrando que os estudos diplomáticos e tipológicos são fundamentais na atividade profissional do Arquivista.

The present research shows the importance of the Archival and the Diplomatic in the social context based on their scientific methods. It is demonstrated through the analysis of the Land Registry the real estate growth and the evolution of the city. The analysis of the legislation of each period surveyed aligned with the studies of diplomatic analysis and typological analysis provided sufficient theoretical background to answer the proposed problem, exposing the question of the changes in the forms of registering a property and its reflection in the records. The aim of this research was to understand how land registries were carried out in Porto Alegre from 1850 to the advent of the Brazilian Civil Code. For this, it is proposed to analyze the intrinsic and extrinsic characteristics of the Land Registry in Porto Alegre, the understanding directed to the issue of the semantic construction of the registry. For that purpose, the concepts on Archival, Diplomatic and Documentary Typology were revised. The analyzes were based on the support of the Diplomatic concepts and the forms of presentation of the records along with the intrinsic and extrinsic characteristics to counterbalance with the theory upon Documentary Typology. Then, the analysis and identification of possible changes in the external and internal elements of the records from the periods in which changes were made in the legislation was required. The literature review addresses aspects related to the historical context of the Land Registry and property registry in Brazil, going into the analysis of the legislation that protected the right to property at different times. In view of this reality, significant changes were identified in the records, demonstrating that diplomatic and typological studies are fundamental to the professional activity of the Archivist.
